FIRST AMENDMENT TO AGREEMENT <br /> <br /> <br />This First Amendment to Agreement ("First Amendment") is entered into this ____ day of <br />__________ 2024 by the City of Pleasanton ("City") and Tri-Valley Haven ("Contractor”). <br /> <br />Whereas, on July 1, 2023 the City and Contractor entered into an Agreement Concerning <br />the Allocation of Housing & Human Services Grant (HHSG) Funds for Fiscal Year 2023 (23/24) <br />("Agreement"); and <br /> <br />Whereas, the Agreement was stipulated to expire on June 30, 2024, and the parties desire <br />to extend this expiration date; and <br /> <br />Whereas, on May 7, 2024 additional HHSG Funds were approved to be provided to <br />Contractor for Fiscal Year 2024 (24/25); and <br /> <br />Whereas, the parties desire to amend the Agreement to provide for such extension and <br />budget adjustment and to modify the project budget to reallocate funds as follows: <br /> <br />Pre-construction costs (FY2023/24) $250,000 <br />Construction costs (FY2024/25) $250,000 <br /> Total Project Budget $500,000 <br /> <br />Now, therefore, in exchange for valuable consideration, the receipt of which is hereby <br />acknowledged, the parties agree as follows: <br /> <br />1. Section II. Commencement and Completion Requirements, Subsection A. of the Agreement, <br />is amended to extend the term through June 30, 2025. <br /> <br />2. Section IV. Budget, the Program Budget will be increased by an additional $250,000 in <br />federal Community Development Block Grant (CDBG) Program funds for Fiscal Year 2024 <br />(24/25); and <br /> <br />3. All other terms and conditions of the Agreement shall remain in full force and effect. <br /> <br />4. This Fourth Amendment may be executed in multiple counterparts, each of which shall be an <br />original and all of which together shall constitute one agreement. Counterparts may be delivered via <br />facsimile, electronic mail (including pdf or any electronic signature complying with U.S. federal E- <br />Sign Act of 2000 (15 U.S. Code §7001 et seq.), California Uniform Electronic Transactions Act <br />(Cal.
