IN THE AMOUNT OF $64,690 TO PROVIDE <br />ENGINEER'S REPORTS AND PROPOSITION 218 BALLOTING PROCEDURES <br />FOR THE MOLLER RANCH AND PONDEROSA-DEL PRADO LANDSCAPE <br />MAINTENANCE DISTRICTS <br /> <br />SUMMARY <br />On June 18, 2024, the City Council adopted a resolution confirming the Engineer’s Reports for <br />the City’s five Landscape Maintenance Districts (LMDs). The Engineer’s Reports for the Moller <br />Ranch and Ponderosa-Del Prado LMDs allocated funding for the proposed services from SCI. <br /> <br />Staff recommends the approval of a professional services agreement with SCI for a not-to- <br />exceed amount of $64,690 to provide the services required for this project. The term of the <br />agreement is from October 2024 through December 31, 2025. Staff also recommends the City <br />Council authorize the Director of Public Works to execute amendments for a not-to-exceed <br />amount of $6,500. The costs for the project are fully funded by the Landscape Maintenance <br />District reserve funds. <br /> <br />RECOMMENDATION <br />1. Approve the professional services agreement with SCI Consulting Group, Inc. in the <br />amount of $64,690 to provide engineers reports and Proposition 218 balloting <br />procedures for the Moller Ranch and Ponderosa-Del Prado Landscape Maintenance <br />Districts and authorize the City Manager to execute the agreement.  <br />2. Authorize the Director of Public Works to execute amendments to the professional <br />service agreement up to a not-to-exceed amount of $6,500 (approximately 10 percent) <br />for unforeseen yet necessary related work. <br /> <br /> <br />BACKGROUND <br />The Landscaping and Lighting Act of 1972 authorizes local agencies to impose an annual <br />assessment on real property benefiting from project-specific improvements to pay for the <br />construction and maintenance of landscaping and lighting special improvements that benefit <br />those parcels. The assessments are collected by the Alameda County Assessor’s Office to be <br />applied to each owner’s property tax bill.  <br /> <br />For each LMD, City staff follows a statutorily imposed process for yearly administration. The <br />engineer’s budget for each district includes a reserve fund to provide for the replacement of <br />capital improvements such as planting, irrigation, decorative entry walls, signage, light fixtures, <br />etc. Currently, the reserve funds are insufficient to cover these replacement costs.  <br /> <br />Page 24 of 90
