Page 2 of 3 <br />cost-based adjustment to garbage rates is being allocated to support the new Waste and <br />Recycling Manager position that will oversee the City’s waste and recycling team and the <br />Franchise Agreement, as well as other waste and recycling related programs and projects. <br /> <br />Adequate staffing of the City's waste and recycling program is essential to assure compliance <br />with state laws, including SB 1383. The penalty for non-compliance with SB1383 could result <br />in fines that range from $500-$10,000 per day. If CalRecycle (the State Department of <br />Resources Recycling and Recovery) finds a jurisdiction in violation of the regulations, pursuant <br />to Title 14, CCR, Article 16 section 18997.3, CalRecycle shall impose penalties <br />administratively as follows: <br /> <br />Minor violation $500 to $4,000 per violation per day <br />Moderate violation $4,000 to $7,500 per violation per day <br />Major violation $7,500 to $10,000 per violation per day <br /> <br />As part of the restructuring of the Public Works Department to increase operational efficiency, <br />the Waste and Recycling program, including this position, and other positions supporting the <br />City's waste and recycling efforts, will be transitioned to the Public Works Department later this <br />fiscal year. <br /> <br />EQUITY AND SUSTAINABILITY <br />As a full-service municipality, the City provides a wide range of services and programs to meet <br />the needs of all members of the community. Waste and recycling rates take into account both <br />equity and sustainability considerations to ensure fair access to services and promote <br />environmentally responsible waste management practices. The cost of waste disposal is vital <br />to ensuring that the services the City provides are available in a healthy and safe manner to all <br />members of the Pleasanton community. <br /> <br />OUTREACH <br />On March 18, 2024, a publicly noticed City Council Waste and Recycling subcommittee <br />meeting was held. The addition of the Waste and Recycling Manager position was discussed <br />at a public City Council meeting on May 21, 2024. <br /> <br />STRATEGIC PLAN ALIGNMENT <br />This action advances the ONE Pleasanton strategic plan goal of Investing In Our Environment <br />to continue to implement priority items from the Climate Action Plan 2.0 (CAP) to lead by <br />example in environmental sustainability. <br /> <br />FISCAL IMPACT <br />The Waste and Recycling Manager position has an estimated fully-burdened annual cost of <br />$266,100. As mentioned previously, this position will be funded entirely from the Pleasanton <br />Garbage Service Reserve Fund (Fund 171) based on the approved cost-based rate <br />adjustment for solid waste, recyclable materials, and organic materials collection for fiscal year <br />2024/25.
