2 <br /> <br />4. Lifetime Pays Gym Use Fees. Lifetime shall pay an hourly gym use fee for gym space <br />approved by the City under Section 2. The hourly rate is based on the amount charged by the <br />Pleasanton Unified School District. The hourly rates shall be: <br /> <br />a. July 1, 2024 to June 30, 2025 = $ 21.00/hour full gym use <br />b. July 1, 2024 to June 30, 2025 = $ 10.50/hour half gym with City shared joint use <br /> <br /> Payment by Lifetime to City shall be made in full within 30 days of invoice. <br /> <br />5. Access to Gyms with Key Cards. The City has issued Lifetime key cards (a.k.a. prox <br />cards) whereby Lifetime staff can open and access gyms independently. Lifetime shall <br />immediately report to the City any lost or stolen key cards by contacting the City staff person <br />listed in Section 6.D., below. Lifetime shall pay a $25.00 replacement fee for each key card that <br />needs to be replaced. <br /> <br />6. Responsible for Employees. Lifetime shall recruit, hire, train, discharge, evaluate, <br />supervise and pay all Lifetime’s employees providing the activities described in this Agreement. <br /> <br />A. Lifetime shall be responsible on an on-going basis for ensuring that all of Lifetime’s <br />employees, contractors’ employees, independent contractors and volunteers that have a position <br />of supervisory or disciplinary authority over a child under the age of eighteen (18) [whether such <br />child is registered for activities or is an employee] have been background checked and meet the <br />requirements of California Public Resources Code §5164(a)(1) and California Penal Code <br />§11105.3. Lifetime shall provide proof thereof when requested by the City. <br /> <br />B. Lifetime shall be responsible on an on-going basis for ensuring that all of Lifetime’s <br />employees, contractors’ employees, independent contractors, and volunteers have been found to <br />be free of communicable tuberculosis as provided in California Public Resources Code §5163. <br />Lifetime shall provide proof thereof when requested by the City. <br /> <br />7. Custodial <br />a. At the end of each day of Lifetime use, Lifetime shall be responsible for leaving <br />the Gymnasium Facilities in a safe, clean, and hygienic condition, which shall <br />include, at a minimum, ensuring that all rubbish is placed in trash containers <br />and/or dumpsters; sweeping or dust mopping the floors; and removing all <br />equipment and personal property from the Gymnasium Facilities. <br /> <br />8. Safety and Security. <br />A. Lifetime shall post appropriate caution signs at gyms to alert personnel and the <br />public of any unsafe conditions when Lifetime becomes aware of such unsafe <br />conditions. <br /> <br />B.
