2 5. Contractor shall publish all City legal notices in type not smaller than nonpareil. All headings shall be printed in blackface type not smaller than nonpareil. No matter other than headings shall be printed in blackface type, and no publication shall be set in type larger than nonpareil, except upon written order of the City. 6. Contractor shall remain a newspaper of general circulation within the city of Pleasanton for the term of this Agreement. 7. Contractor agrees that it shall distribute copies of the East Bay Times, inclusive of the Valley Times, in the city of Pleasanton, seven (7) days a week, during the term of this Agreement. The average daily circulation in Pleasanton is 1,644. 8. The term of this Agreement shall be effective July 1, 2024, to June 30, 2025. 9. This Agreement may be executed in multiple counterparts, each of which shall be an original and all of which together shall constitute one agreement. Counterparts may be delivered via facsimile, electronic mail (including pdf or any electronic signature complying with U.S. federal E-Sign Act of 2000 (15 U.S. Code §7001 et seq.), California Uniform Electronic Transactions Act (Cal. Civil Code §1633.1 et seq.), or other applicable law) or other transmission method, and any counterpart so delivered shall be deemed to have been duly and validly delivered and be valid and effective for all purposes.
