F. The City and District wish to clarify use of the Middle School Gymnasiums for Fiscal Year 2024/2025. NOW THEREFORE, in consideration of the mutual covenants and conditions in this Agreement, City and School District agree as follows: 2. Term. a. The term of this Agreement is from July 1, 2024 to June 30, 2025. b. Either Party may terminate this Agreement prior to the expiration of its Term by giving the other Party a thirty (30) day written notice of termination. 3. Costs. a. For hours that City uses the Middle School Gymnasiums, City shall pay district as follows: i. $15.00 per hour for the cost of utilities necessary to operate and manage the Middle School Gymnasiums, including but not limited to electricity, gas, telephone, internet, water, sewer, air conditioning and trash disposal; ii. $39.32 per hour (Monday – Friday); $58.98 per hour (Saturday); and $78.64 per hour (Sunday) for custodial obligations related to maintaining the Middle School Gymnasiums and surrounding areas; and iii. one-half of the costs of regular maintenance, repair, and upkeep of the Middle School Gymnasiums. b. District shall invoice City quarterly for the itemized costs specified in subsection a, above. City shall pay the invoice within thirty-days upon receipt. c. Payments made by City to District under this Agreement shall not exceed $75,000. 4. Relationship to Middle School Gymnasium Agreements. The Middle School Gymnasium Agreements remain in full force and effect. However, to the extent there are conflicts between the terms of the Middle School Gymnasium Agreements and this Agreement, the terms of this Agreement shall prevail. 5. Assignment. Neither Party may assign its rights or delegate its duties pursuant to this Agreement. 6. Modifications.
