AGREEMENT BETWEEN CITY OF PLEASANTON AND PLEASANTON UNIFIED SCHOOL DISTRICT FOR JOINT USE OF MIDDLE SCHOOL GYMNASIUMS FOR FISCAL YEAR 2024/2025 THIS AGREEMENT (“Agreement”) is made and entered into this 1 day of July, 2024, by and between the CITY OF PLEASANTON, a municipal corporation (“City”) and the PLEASANTON UNIFIED SCHOOL DISTRICT (“District”), each also individually referred to as “Party” and collectively referred to as the “Parties.” RECITALS A. City and District share use of gymnasiums at three Middle Schools: Pleasanton Middle School, Harvest Park Middle School, and Hart Middle School (collectively referred to as “Middle School Gymnasiums”). B. On May 8, 1990, City and District entered into an Agreement Relating to Joint Use of Two Gymnasiums and Ground Lease for a Joint Use Facilities at Pleasanton Middle School (“Pleasanton Middle School Joint Use Agreement”); and C. On February 12, 1991, City and District entered into an Agreement Relating to Joint Use of Two Gymnasiums for a Joint Use Facilities at Harvest Park Middle School (“Harvest Park Middle School Joint Use Agreement”). The Parties also entered into a First Amendment to the Harvest Park Middle School Joint Use Agreement on September 3, 1991, and a Custodial Services Agreement related to the Pleasanton Middle School Joint Use Agreement and the Harvest Park Middle School Joint Use Agreement on October 8, 1991 (“Custodial Services Agreement”); and D. On July 1, 2000, City and District entered into an Agreement Relating to Joint Use of Hart Middle School Gymnasium for a Joint Use Facilities at Hart Middle School (“Hart Middle School Joint Use Agreement”); and E. The Pleasanton Middle School Joint Use Agreement, the Harvest Park Middle School Joint Use Agreement, the Custodial Services Agreement, and the Hart Middle School Joint Use Agreement are collectively referred to in this Agreement as “Middle School Gymnasium Agreements.” DocuSign Envelope ID: FA937DF2-026E-4876-839F-639FC2421333
