RESOLUTION NO. 2024-029 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON OF <br />SUMMARY VACATION FOR PUBLIC SERVICE EASEMENT AT 870 ST. JOHN COURT <br />WHEREAS, On June 28, 1995, the City Council adopted Resolution PC -95-41, approving <br />Vesting Tentative Tract Map 6728 (St. John Place). This Resolution allowed the Stringer <br />Company to subdivide an approximately 7.6 -acre site into 43 single-family residential lots with <br />common open space. The Vesting Tentative Tract Map included Lot 11, now known as 870 St. <br />John Court; and <br />WHEREAS, On December 4, 1995, the City Council held a Special Meeting and voted to <br />approve the final map for Tract 6728 (St. John Place) and accept all parcels of land and <br />easements as offered for dedication including public service easements. Said final map was <br />subsequently recorded on February 23, 1996 (Book 224 of Maps at Pages 14 through 17); and <br />WHEREAS, on October 7, 1997, the City Council authorized the City Clerk to file a Notice <br />of Completion for subdivision improvements built as part of Tract 6728, St. John Place (New Cities <br />Development Group and The Stringer Company); and <br />WHEREAS, the current owners of 870 St. John Court, Jim and Denise Lehrman, have <br />asked the City to vacate a portion of the public service easement that encumbers their residential <br />lot; and <br />WHEREAS, local utility purveyors who benefit from public service easements held by the <br />City were sent formal notices about the proposed vacation asking whether they would object. No <br />objections were submitted, and the City confirmed that no public utilities currently reside within <br />the vacation area; and <br />WHEREAS, the City Council, as legislative body, has been granted the authority to <br />summarily vacate public easements that are no longer needed or relevant according to the <br />regulatory procedure prescribed by §8330 et seq. of the California Streets and Highways Code. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br />SECTION 1. This Resolution of Summary Vacation for Public Service and Access <br />Easement at 870 St. John Court is hereby adopted based on the following: <br />• The summary vacation of Public Service Easement is made under California <br />Streets and Highways Code §8330 et seq. <br />• The portion of the Public Service Easement to be summarily vacated was granted <br />across Lot 11 of Tract Map 6728 (Book 224 of maps at Pages 14 through 17) as <br />accepted by the City Clerk and as described in detail in the Quitclaim of Public <br />Service Easement across 870 St. John Court to be recorded together with this <br />Resolution. <br />• This Resolution is prima facie evidence that the Public Service Easement is <br />determined to be excess. <br />• That from and after the date this Resolution is recorded, the vacated Public Service <br />Easement no longer constitutes a street, highway, or public service easement. <br />
