DocuSign Envelope ID: 4BE41ABD-CDC3-4DEF-91 DE -1 EFE877592DC <br />Contractor, its agents, sub -contractors, officials or employees, in connection with <br />the execution of the work covered by this Contract or any amendments thereto. <br />Certification re Workers' Compensation. In accordance with Section 1861 of the <br />California Labor Code, each contractor to whom a public works contract is awarded shall <br />sign and file with the awarding body the following certification prior to performing the <br />work of the contract: I am aware of the provisions of Section 3700 of the Labor Code <br />which require every employer to be insured against liability for workers' compensation or <br />to undertake self-insurance in accordance with the provisions of that code, and I will <br />comply with such provisions before commencing the performance of the work of this <br />contract." <br />Department of Industrial Relations: Pursuant to Labor Code section 1771.1, the Bidder <br />and its Subcontractors must be registered and qualified to perform public work pursuant <br />to section 1725.5 of the Labor Code, subject to limited legal exceptions. <br />8. Independent Contractor. The Contractor is an independent contractor retained by the <br />City to perform the work described herein. All personnel employed by the Contractor, <br />including subcontractors, and personnel of said subcontractors, are not and shall not be <br />employees of the City. <br />9. Warranty Against Defects. The Contractor hereby warrants all work done under this <br />contract against all defects in materials and workmanship for a period of 12 months <br />following City's acceptance of said work. If any defects occur within said 12 months, the <br />Contractor shall be solely responsible for the correction of those defects. <br />10. Counterparts and Electronic Signatures. This contract may be executed in multiple <br />counterparts, each of which shall be an original and all of which together shall constitute <br />one agreement. Counterparts may be delivered via facsimile, electronic mail (including <br />pdf or any electronic signature complying with U.S. federal E -Sign Act of 2000 (15 U.S. <br />Code §7001 et seq.), California Uniform Electronic Transactions Act (Cal. Civil Code <br />§ 1633.1 et seq.), or other applicable law) or other transmission method, and any <br />counterpart so delivered shall be deemed to have been duly and validly delivered and be <br />valid and effective for all purposes. <br />IN WITNESS WHEREOF, the parties hereto have executed this Agreement the date and <br />year first above written. <br />CONTRARTOR; <br />By: <br />its I A en[- bcrly N.
