Such an action would preclude the applicant/property owners <br />from constructing the tennis court lighting; or <br />2. Approval of the application with modifications. The Planning Commission could approve <br />the ADR for tennis court lighting, but with a modified hour of use, shielding type, or with <br />other changes to the proposal. <br /> <br />Staff believes the project for tennis court lighting, as conditioned, will not adversely impact any <br />surrounding properties or the surrounding neighborhood. Staff recommends none of the <br />alternatives above be pursued. <br /> <br />DESIGN REVIEW CONSIDERATIONS <br />The Pleasanton Municipal Code Section 18.20.030 sets forth the scope of review criteria to be <br />addressed in reviewing projects subject to design review. These criteria are set forth in the <br />draft Resolution included as Exhibit A. As described in Exhibit A and based on the information <br />and analysis provided in this Agenda Report, staff recommends the Commission make the <br />required findings to approve the project. <br /> <br />PUBLIC NOTICE <br />Notice of this application was sent to surrounding property owners and tenants within a <br />1,000-foot radius of the site (Exhibit D). At the time this report was published, staff received <br />neighbor concerns regarding the proposed tennis court lighting. Public comments are included <br />in Exhibit C. Noticed neighbors expressed concerns regarding potential tennis court’s lighting <br />impacts to homes, proximity of the tennis court to adjacent residences, height of light poles, <br />and potential traffic hazard. Additionally, neighbors expressed dissatisfaction of the proposal <br />due to their understanding with the applicant/property owners that tennis court lighting would <br />not be proposed as part of the communication during the PUD application process. <br /> <br />ENVIRONMENTAL ASSESSMENT <br />This project is categorically exempt from the California Environmental Quality Act (CEQA) <br />pursuant to Section 15303, Class 3, New Construction or Conversion of Small Structures. <br />Therefore, no environmental document accompanies this report. <br /> <br />SUMMARY/CONCLUSION <br />As proposed and conditioned, staff believes the proposed tennis court lighting would not <br />adversely impact the surrounding uses. Conditions of approval have been included which will <br />ensure the safety and general welfare of the surrounding area, and the City in general, is <br />maintained.
