RESOLUTION NO. PC-2024-08 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON APPROVING THE APPLICATION TO AMEND PCUP-61, AN <br />EXISTING CONDITIONAL USE PERMIT, WHICH CURRENTLY ALLOWS FOR <br />THE SALE OF BEER AND WINE, TO ALSO ALLOW FOR THE SALE OF <br />DISTILLED SPIRITS FOR OFF-SITE CONSUMPTION (TYPE 21 ABC <br />LICENSE) A AN EXISTING GAS STATION MARKET LOCATED AT 1875 <br />VALLEY AVENUE, AS FILED UNDER CASE NO. P24-0127 <br />WHEREAS, on September 3, 2002, the City Council held a duly-noticed public <br />hearing and unanimously approved the Planned Unit Development and Conditional Use <br />Permit (PUD Case No. PUD-02-4M and CUP Case No. PCUP-61) from Bernal Partners, <br />LLC to construct a self-service gasoline station on an approximately 1.3-acre site <br />consisting of six fuel pumps, an approximately 2,500-square-foot convenience market, an <br />approximately 2,500-square-foot quick-service restaurant with drive-through lane, and a <br />modification to the Bernal Properties PUD development plan to allow an approximately <br />1,300-square-foot drive-through carwash and beer and wine sales from the convenience <br />market; and <br />WHEREAS, on February 15, 2024, Rawlings Consulting, on behalf of Chevron <br />Stations Inc, submitted a CUP application requesting a modification of the previously <br />approved CUP to allow distilled spirits and ready-to-serve beverages to be sold at the gas <br />station market in conjunction with the available beer and wine; <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) District; <br />and <br />WHEREAS, the project is categorically exempt from the California Environmental <br />Quality Act (CEQA) pursuant to Section 15301, (Existing Facilities), since the project <br />would not result in the expansion of the exterior of the building and/or would be limited to <br />an expansion of the use at the existing building. Therefore, no additional environmental <br />review is required; and <br />WHEREAS, on April 24, 2024, the Planning Commission held a duly-noticed public <br />hearing, considered relevant exhibits, recommendations of the City staff concerning this <br />application, and received testimony from the applicant and interested parties. <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City <br />of Pleasanton, based on the entire record of proceedings, including the oral and written <br />agenda reports and all public comment and testimony: <br />Section 1: Findings for Conditional Use Permit Approval <br />With respect to the approval of P24-0127, the Planning Commission makes the following <br />findings as required by Section 18.124.070 of the Pleasanton Municipal Code:
