P24-0127, 1875 Valley Avenue Planning Commission <br />7 of 7 <br />However, alternatives to the proposal that could be considered by the Planning Commission <br />include: <br /> <br />1. Approval of the request subject to the recommended conditions of approval; or <br />2. Denial of the request, therefore the existing gas station market would continue to offer <br />only beer and wine; or <br />3. Approval of the request with modified hours, location of alcoholic beverages, <br />percentage of square footage allowed for alcohol, etc. <br /> <br />PUBLIC NOTICE AND COMMENTS <br />Notices of this application were sent to surrounding property owners and tenants within a <br />1,000-foot radius of the site. At the time this report was published, staff had received one <br />public comment regarding the project from a community member who is not in support of the <br />modification to the CUP. The comment has been included for your reference as Exhibit F. <br /> <br />ENVIRONMENTAL ASSESSMENT <br />This project is categorically exempt (Section 15301, Class 1, Existing Facilities) from the <br />requirements of the California Environmental Quality Act (CEQA). Therefore, no environmental <br />document accompanies this report. <br /> <br />SUMMARY/CONCLUSION <br />The gas station service market has proved it is being operated in a professional manner, <br />without a history of complaints or issues since the prior modification to the Use Permit in 2004, <br />and is a desirable and necessary business in the community. As proposed and conditioned, <br />staff believes the proposed expansion of alcoholic beverage offerings will be compatible with <br />and will not detrimentally affect the existing or future adjacent/nearby uses. Conditions of <br />approval have been included which will ensure the safety and general welfare of the <br />surrounding area, and the City in general, is maintained.
