P23-0599 Planning Commission <br />Page 2 of 2 <br />WHEREAS, denial of a project is not an action subject to the California Environmental <br />Quality Act (CEQA). <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br />Pleasanton, based on the entire record of proceedings, including the oral and written staff <br />reports and all public comment and testimony: <br />Section 1: <br />The Planning Commission hereby denies Case No. P23-0599 to demolish two existing <br />commercial buildings and construct 146 multi-family residential units with 38 accessory <br />dwelling units with associated site improvements located at 5976 & 5994 West Las Positas <br />Boulevard, on the basis that the proposed use is not consistent with the General Plan policy <br />per General Plan page 2-23 and because the zoning for the property does not permit <br />residential development except for Nursing Homes/Assisted Living Facilities. <br />Section 2: <br />This resolution shall become effective 15 days after its passage and adoption unless appealed <br />prior to that time. <br />PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of <br />Pleasanton at a regular meeting held on April 10, 2024, by the following vote: <br />Ayes: Commissioners <br />Noes: Commissioners <br />Absent: Commissioners <br />Abstain: Commissioners <br />ATTEST: <br />_____________________________ ______________________________ <br />Melinda Denis Matthew Gaidos <br />Secretary, Planning Commission Chair <br />APPROVED AS TO FORM: <br />______________________________ <br />Julie Harryman <br />Assistant City Attorney
