RESOLUTION NO. PC-2024-07 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />DENYING APPLICATION FOR DESIGN REVIEW AND A VESTING TENTATIVE MAP FOR <br />A HOUSING DEVELOPMENT THAT INCLUDES THE DEMOLITION OF TWO EXISTING <br />COMMERCIAL BUILDINGS AND CONSTRUCTION OF 146 MULTI-FAMILY RESIDENTIAL <br />UNITS WITH 38 ACCESSORY DWELLING UNITS WITH ASSOCIATED SITE <br />IMPROVEMENTS LOCATED AT 5976 & 5994 WEST LAS POSITAS BOULEVARD, AS <br />FILED UNDER CASE NO. P23-0599 <br />WHEREAS, on January 26, 2023, Kelley Rutchena, TTLC Pleasanton - Las Positas, <br />LLC, applied for preliminary review pursuant to Senate Bill 330 for a housing development that <br />includes the demolition of two existing commercial buildings and construction of 146 multi- <br />family residential units with 38 accessory dwelling units with associated site improvements <br />located at 5976 & 5994 West Las Positas Boulevard; and <br />WHEREAS, on July 24, 2023, Kelley Rutchena, TTLC Pleasanton - Las Positas, LLC, <br />applied for Design Review and a Vesting Tentative Map for a housing development that <br />includes the demolition of two existing commercial buildings and construction of 146 multi- <br />family residential units with 38 accessory dwelling units with associated site improvements <br />located at 5976 & 5994 West Las Positas Boulevard; and <br />WHEREAS, zoning for the property is PUD-I/C-O (Planned Unit Development – <br />Industrial/Commercial and Office) and the General Plan designation is Mixed Use/Business <br />Park; and <br />WHEREAS, the General Plan's Mixed Use designation references and defers to the <br />applicable Planned Unit Development per General Plan Page 2-25 stating: “The location of <br />specific land uses in areas designated Mixed Use is determined by the associated PUD zoning <br />or specific plan.”; and <br />WHEREAS, the property is located within the Hacienda Business Park (“Hacienda”) <br />zoned PUD-I/C-O (Planned Unit Development – Industrial/Commercial and Office); and <br />WHEREAS, the property is lot 20 within Hacienda’s Land Use Plan, which is subject to <br />the Garden Office District (“OGPD”); and <br />WHEREAS,Hacienda’s Land Use Plan permitted and conditionally permitted uses for a <br />property in the Garden Office District are those specified in the O (“Office”) District, as set forth <br />in Section 18.44.080 of the Pleasanton Municipal Code (PMC); and <br />WHEREAS, Hacienda’s Land Use Plan for lot 20 does not permit residential <br />development except for Nursing Homes/Assisted Living Facilities; and <br />WHEREAS, on April 10, 2024, the Planning Commission held a duly-noticed public <br />hearing and considered relevant exhibits, recommendations of the City staff concerning this <br />appeal, and received testimony from the applicant and interested parties; and
