Las Positas Blvd. Planning Commission <br />6 of 8 <br />Figure 7: Vesting Tentative Map <br /> <br />ANALYSIS <br />Design Review Application <br />Under the City’s Design Review provisions (Pleasanton Municipal Code (PMC) Chapter <br />18.20), the Planning Commission has the power and duty to make sure that projects conform <br />to the goals and policies of the general plan, and relevant specific plan, and/or the purposes <br />and objectives of the zoning district. (PMC § 18.20.020.) The Planning Commission must <br />review applications to ensure the preservation and enhancement of the City's aesthetic values <br />and the preservation of public health, safety and general welfare. (PMC § 18.20.030.) Zoning <br />is a fundamental aspect of the public health, safety and general welfare of the City.2 <br /> <br />The subject property is located within the Hacienda Business Park (“Hacienda”) zoned PUD- <br />I/C-O (Planned Unit Development) – Industrial/Commercial and Office District and with the <br />General Plan Designation of Mixed Use/Business Park. Development within Hacienda, which <br />includes the subject property, is regulated by the Hacienda Design Guidelines, Hacienda’s <br />Covenants, Conditions, and Restrictions, the Development Plan, and Pleasanton municipal <br />codes and ordinances. The Hacienda PUD development plan includes a Land Use Plan (also <br />shown in the Design Guidelines) that illustrates the variety and locations of land uses intended <br />to occupy Hacienda, referred to as “planning districts.” The planning districts include <br />Retail/Commercial Centers, Garden Office, Midrise Office, General Office, Research and <br />Development, Light Manufacturing, High Density Residential, Mixed Office/Industrial, Mixed <br />Commercial/Office/Industrial and Mixed Use. <br /> <br />The subject property is Lot 20 within Hacienda’s Land Use Plan, which is subject to the <br />Garden Office District (“OGPD”). Per the Land Use Plan, the permitted and conditionally <br />permitted uses for a property in the Garden Office District are those specified in the O <br />(“Office”) District, as set forth in Section 18.44.080 of the PMC. In PMC Table 18.44.080 <br />Permitted and Conditional Uses, the only permitted and conditionally permitted residential uses <br />are shown in Table 18.44.080 below: <br /> <br /> <br />2 See Miller v.
