MEMORANDUM <br />Date: March 7, 2024 <br />To: Chair and Members of the Planning Commission <br />From: Ellen Clark, Director of Community Development <br />Re: March 13, 2024 – Item 4: P23-0177, Design Review and Vesting Tentative Map <br />for 3200 Hopyard Road <br />At the February 28, 2024, Planning Commission public hearing, the Commission voted 4-1 to <br />continue the Public Hearing for the above-referenced item to March 13, 2024, with the <br />direction for staff to provide further clarifying details about the traffic study by TJKM, additional <br />parking on-site, and access from Hopyard Road. This memorandum provides further <br />information and addresses some further concerns and questions that were raised by members <br />of the public during the public hearing. <br />The applicant has indicated they are continuing to look at refinements to the project in an effort <br />to be responsive to concerns raised by neighbors around privacy, building massing and guest <br />parking, while at the same time recognizing staff’s conclusions and recommendation for project <br />approval based on its conformance to applicable standards. To the extent such revisions or <br />refinements are submitted to the City in advance of the March 13, 2024, public hearing, they <br />will be made available to the Planning Commission and to the public. <br />Regulatory Context <br />The February 28, 2024, report provides extensive background on the various State laws <br />applicable to this project, which include Senate Bill 330 that, together with other State law <br />including the Housing Accountability Act, impose limitations on the nature of the specific <br />development standards that may be applied to the project; and restrict the reasons for which <br />the City may approve, deny, or require modifications to the project. State Housing Density <br />Bonus Law, for which this project qualifies, also permits a developer to request concessions <br />and waivers of development standards that (respectively) cause increased project costs; or <br />would physically preclude the development at the density allowed by the City’s General Plan, <br />and/or requested via the density bonus. Please refer to the February 28th Agenda Report for <br />additional information on the applicable State laws, and specific concessions and waivers <br />being requested for the project. In addition, Attachment 1 to this cover memo provides an <br />overview of housing laws governing review of development proposals.
