Based on information provided about other <br />Bottoms Up Espresso locations, employees’ dress involves the display of “specified anatomical parts” <br />and therefore defines your business as an adult entertainment establishment. See attached. <br /> <br />Within the neighborhood commercial district, the permitted and conditional uses are listed in the table in <br />Pleasanton Municipal Code §18.44.080. The following uses are relevant to your application: <br /> <br /> CN - Neighborhood Commercial District <br />CULTURAL AND ENTERTAINMENT <br /> Adult entertainment establishments3 <br />RETAIL <br /> Restaurants and catering establishments29 Permitted - P <br /> <br />3 See Chapter 18.114 of this title. <br /> <br />29 Any use that includes a drive-through shall be subject to a conditional use permit as <br />prescribed in Chapter 18.124. <br /> <br />As adult entertainment establishments are not permitted in the CN zoning district where the 4299 Santa <br />Rita Road kiosk is located, your application is denied per my authority as Zoning Administrator <br />pursuant to Pleasanton Municipal Code §18.12.060. <br /> <br />While I can be reached at (925) 931-5612 or eluchini@cityofpleasantonca.gov, your ability to appeal my <br />decision to the Planning Commission is governed by Pleasanton Municipal Code §§18.144.020 and <br />18.144.050.
