Resolution No. 2024-021 <br /> Page 3 of 7 <br /> INTERIM POLICE CHIEF AGREEMENT <br /> THIS INTERIM POLICE CHIEF AGREEMENT ("Agreement") is entered into this 3rd <br /> day of May 2024, between the CITY OF PLEASANTON, a municipal corporation("City"), and <br /> Gina Anderson ("Chief Anderson"). <br /> RECITALS <br /> WHEREAS, City desires to employ the services of Chief Anderson as its Interim Police <br /> Chief, temporarily, to carry out the duties and responsibilities of Police Chief, in consideration of <br /> and subject to the terms, conditions, and benefits set forth in this Agreement; and <br /> WHEREAS, Chief Anderson is currently a retired Police Chief and has over thirty years <br /> of law enforcement experience; and <br /> WHEREAS, Chief Anderson agrees to accept employment as Interim Police Chief of the <br /> City of Pleasanton in consideration of and subject to the terms, conditions, and benefits set forth <br /> in this Agreement; and <br /> WHEREAS, City has determined that it is necessary to hire Chief Anderson because the <br /> position of Interim Police Chief is required for adequate staffing and public safety; and <br /> WHEREAS, Chief Anderson wishes to serve as temporary,Interim Police Chief while the <br /> City recruits for a permanent Police Chief, and <br /> WHEREAS,the parties wish to set forth the terms upon which the temporary employment <br /> will be based; and <br /> WHEREAS, while Pleasanton Municipal Code §2.08.100 makes it the duty of the City <br /> Manager to appoint employees, California law (Government Code' §21221(h)) requires the City <br /> Council to make interim appointments of certain retirees to vacant positions while recruitment <br /> occurs, and Chief Anderson qualifies for such interim appointment following Chief Anderson's <br /> retirement from her prior employer pursuant to §7522.56(f)(4). <br /> NOW THEREFORE, in consideration of the mutual covenants and conditions in this <br /> Agreement, City and Chief Anderson agree as follows: <br /> 1. Interim Position. Chief Anderson accepts employment with the City as its Interim <br /> Police Chief and shall oversee the police department and perform all functions, duties and <br /> services set forth in this Agreement. Chief Anderson shall provide service at the direction and <br /> under the supervision of the City Manager. It is the intent of the parties that Chief Anderson, <br /> as the Interim Police Chief, shall keep the City Manager fully apprised of all significant <br /> ongoing operations of the City's police department. <br /> 2. Term. This Agreement shall become effective when executed both by Chief <br /> Anderson and the City Manager, which date shall be the date first referenced above.
