RESOLUTION NO. 2024-013
<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING
<br /> THE PURCHASING PROCEDURES AND MANUAL TO ADD A DEFINITION OF
<br /> PUBLIC PROJECT, AND CREATE PROCEDURE FOR EXTRA WORK FOR TIME-
<br /> CRITICAL PUBLIC WORKS PROJECT AGREEMENTS
<br /> WHEREAS, the California Public Contract Code §§22000 et seq., the Uniform Public
<br /> Construction Cost Accounting Act establishes a uniform cost accounting standard, which the
<br /> City adopted by Resolution No. 91-170; and
<br /> WHEREAS, the Act in California Public Contract Code §22022(c) provides a definition
<br /> "public project"; and
<br /> WHEREAS, the inclusion of that definition of"public project" into the Purchasing
<br /> Procedures and Manual would help clarify the types of projects subject to the formal bidding
<br /> process required for public work projects; and
<br /> WHEREAS, Pleasanton Municipal Code Chapter 3.32 and the Manual include procedures
<br /> for public works project agreements, and the Manual was most recently amended on March 21,
<br /> 2023, by Resolution No. 23-1373; and
<br /> WHEREAS, an amendment is needed to clarify that for time-critical public works projects
<br /> that the City Manager, Director of Public Works, and Director of Finance can administratively allow
<br /> for extra work, and then must subsequently bring that amendment to the City Council for
<br /> ratification and funding allocation.
<br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES
<br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING:
<br /> SECTION 1. Amends the Purchasing Procedures and Manual by adding a definition for
<br /> "public project" to Section 3. Definitions as follows:
<br /> 3.15. Public Proiect: "Public project" means any of the following: (1) Construction,
<br /> reconstruction, erection, alteration, renovation, improvement, demolition, and repair work
<br /> involving any publicly owned, leased, or operated facility; (2) painting or repainting any publicly
<br /> owned, leased, or operated facility; (3) in the case of a publicly owned utility system, "public
<br /> project" shall include only the construction, erection improvement, or repair of dams, reservoirs,
<br /> powerplants, and electrical transmission lines of 230,000 volts and higher.
<br /> "Public project" does not include maintenance work including all of the following: (1)
<br /> routine, recurring, and usual work for the preservation or protection of any publicly owned or
<br /> publicly operated facility for its intended purposes; (2) minor repainting; (3) resurfacing of streets
<br /> and highways at less than one inch; (4) landscape maintenance, including mowing, watering,
<br /> trimming, pruning, planting, replacement of plants, and servicing of irrigation and sprinkler
<br /> systems; (5) work performed to keep, operate, and maintain publicly owned water, power, or
<br /> waste disposal systems, including but not limited to, dams, reservoirs, powerplants, and electrical
<br /> transmission lines of 230,000 volts and higher.
