The City previously by Resolution No. 91-170 elected to have the City implement <br />the state’s Uniform Public Construction Code Accounting Act. <br /> <br />The second amendment relates to agreements where work exceeds the agreement amount. In <br />the Manual and Municipal Code Chapter 3.32, the Council approves agreements for capital <br />construction projects greater than $200,000. The Manual is proposed to be amended to: (a) <br />allow the City Manager, Finance Director and Public Works Director to administratively <br />approve an increase in work for such an agreement that would be above the amount and <br />contingency approved by the City Council; (b) limit such administrative action to time-critical <br />situations when prior Council approval is not possible (for example, open trench for pipe <br />construction project encounters unknown conflict that needs extra work to minimize time trench <br />is open); and (c) require that formal City Council ratification of an amendment to the agreement <br />be brought to City Council at the next City Council meeting when noticing and agenda <br />requirements can reasonably be met. <br /> <br />2. The Master Fee Schedule is also proposed to be amended (Attachment 3) to: <br />a. Wireless service facilities are regulated by Municipal Code Chapter 18.110. In response <br />to Federal Communication Commission (FCC) rule changes in 2019, fees were adopted <br />for processing small wireless facility applications (see Res. 19-1124). It is proposed that <br />the Master Fee Schedule be amended to adjust the fees for inflation from 2019 to 2024, <br />and then provide for an annual inflation adjustment. <br />b. False alarm fines in the Master Fee Schedule were set in 1985. This amendment would <br />update the fines to reflect a portion of the actual current cost of police response, and <br />include an automatic inflation adjustment. <br /> <br /> <br />EQUITY AND SUSTAINABILITY <br />Updating the Municipal Code, Purchasing Procedures and Manual, and Master Fee Schedule, <br />furthers, for example, equitable access to recreational facilities by eliminating director <br />discretion in approval of rentals where alcohol is proposed to be served, and instead sets <br />policies uniformly applicable to all persons. For sustainability, code changes to prohibit dogs <br />on sports courts keeps these recreational resources used for their intended purpose for longer <br />periods, and requires less maintenance. <br /> <br />OUTREACH <br />No outreach was conducted, as this item is a routine matter of City business. <br /> <br />STRATEGIC PLAN ALIGNMENT <br />This action advances the ONE Pleasanton Strategic Plan goals of Safeguarding our City, <br />Strategy 1, by implementing changes to improve emergency preparedness capabilities by <br />preserving police patrol resources by reducing false alarms by updating fines; Building a <br />Community Where Everyone Belongs, Strategy 6, by implementing the Housing Element <br />programs by updating zoning code provisions regarding accessory dwelling units to align with <br />state law; and Funding our Future, Strategy 6 by updating the City's fee schedule to ensure <br />fees charges represent costs of services. <br /> <br />FISCAL IMPACT <br />Page 9 of 559
