Page 3 of 5 <br /> <br />In Chapter 13.08 Parks and Recreation Facilities – Amend §13.08.130 Alcoholic Beverage. <br />Amendment to reflect actual City practice of allowing persons renting recreation facilities (e.g. <br />Senior Center, Veterans’ Hall) to serve alcohol, where City may require server to have Cal. <br />Dept. of Alcohol Beverage Control (ABC) license (e.g. bartender or caterer license) and the <br />renter to provide host liquor liability insurance. <br /> <br />In Title 18 Zoning Code: <br /> <br />Chapter 18.08 Definitions – add new definitions for: low barrier navigation center, single room <br />occupancy unit, residential care facility, and transient occupancy; and amend the definition of: <br />supportive housing to reflect changes in state law, operations services director to public works <br />director, and zoning administrator to include designee per actual practice. <br /> <br />Chapter 18.36 RM Multi-family residential districts - amend conditional uses in multi-family <br />residential districts to add as conditional uses single room occupancy unit facilities, and as <br />permitted uses residential care facilities with up to six residents, and low barrier navigation <br />centers. Also related changes to off-street parking in 18.88.030. These changes are needed to <br />conform with state law. <br /> <br />Chapter 18.107 Supporting housing, transitional housing, and single room occupancy unit <br />facilities – added new definitions and standards to comply with state law (AB 2339 of 2022). <br /> <br />Chapter 18.106 Accessory and junior accessory dwelling units - changes to allowed height and <br />rental provisions to align with state law (AB 2221 and SB 897 of 2022). <br /> <br />Section 18.82.040 Permitting procedures and standards – amend parking requirements and <br />minimum separation requirements for homeless shelters as required by state law (AB 2553 of <br />2020). <br /> <br />These amendments to Title 18 Zoning Code implement Housing Element Policy 4.3 “Update <br />City codes, policies and regulations, or implementation thereof, as needed to comply with state <br />law and remove governmental constraints on housing production.”; and Policy 5.3 “Provide <br />opportunities, including appropriately zoned sites, to accommodate housing that can assist <br />individuals’ transition from homelessness, including Single Room Occupancy Units (SROs), <br />emergency shelter and transitional housing for unhoused residents.” <br /> <br />Chapter 18.144 Appeals - Amendments are proposed to harmonize with the City Council <br />Rules of Procedure Section 13.3.3. Council Review, as well as to meet due process <br />considerations in response to court decisions. <br /> <br />The two proposed resolutions address the following: <br />1. The Purchasing Procedures and Manual guides the purchase of goods and services, as <br />well as bidding processes for public works projects. (Attachment 2) <br /> <br />The first amendment proposes to add a definition of “public project” to align with California <br />Public Contracts Code §22022(c) to clarify which types of project are subject to formal bidding <br />Page 8 of 559
