SECTION 7. BINGO MACHINES. It shall be unlawful for any <br /> person to keep or use in any public place any pinball machine of <br /> a type commonly known as a :'BingoT, type or i'~In-Line~ type or a <br /> type wherein the winning of a game, or games, is achieved by <br /> the placing of balls into holes or cups in such a manner as to <br /> activate, record or light up figures or numbers on a score board <br /> so as to record a series of-numbers in any contiguous horizontal, <br /> vertical or diagonal straight line similar to a bingo game score. <br /> <br /> SECTION 8. MISDEMEANOR. Any person, firm or corporation, <br /> whether acting as principal, agent or employee, who violates or <br /> causes the violation of any of the provisions of this ordinance <br /> shall be guilty of a misdemeanor. <br /> <br /> SECTION 9. PUNISHMENT. Upon conviction such person shall be <br />punishable by a fine of not more than $500.00 or by imprisonment <br />for a term not exceeding 6 months or by both such fine and <br />imprisonment. <br /> <br /> SECTION 10. REPEAL. All ordinances and part of ordinances <br />of the City~of Pleasanton in conflict with this ordinance to the <br />extent of such conflict and no further are hereby repealed. <br /> <br /> SECTION 11. VALIDITY. If any section, subsection, sentence, <br />clause or phrase of this ordinance is for any reason held by a <br />court of competent jurisdiction to be invalid, such a decision <br />shall not affect the validity of the remaining portions of this <br />ordinance.
