<br />Resolution No. PC-97-25 <br />Page 4 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case UP-97-03 <br /> <br />1. The proposed use shall conform substantially to the site plan, floor plan, partial roof plan, <br />written narrative, and related materials, Exhibit A (dated "Received" January 8, and <br />February 28, 1997), on file with the Planning Department, except as modified by these <br />conditions. <br /> <br />2. If operation of this use results in conflicts pertaining to parking, litter, noise, traffic, or <br />other impacts, at the discretion of the Planning Director, this conditional use permit may <br />be referred to the Planning Commission for subsequent review at a public hearing. If <br />necessary, the Commission may modify or add conditions of approval to mitigate such <br />impacts, or may revoke said conditional use permit. Such conditions could include a <br />reduction in the hours of operation or prohibition of alcohol sales. <br /> <br />3. The subject conditional use permit shall be reviewed by the Planning Director in 6 <br />months to determine if the business is operating in a non-nuisance manner. If necessary, <br />the conditional use permit may be brought back to the Planning Commission for <br />additional conditions to mitigate and/or prevent any nuisances that were identified. <br /> <br />4. If additional activities beyond that proposed in the written narrative, dated "Received" <br />January 8, 1997 on file with the Planning Department, are desired, prior City review and <br />approval is required. Such modifications shall be submitted to the Planning Director, <br />who shall refer the matter to the Planning Commission if judged to be substantial. <br /> <br />5. The convenience market employees shall not dispose of waste or recyclables in <br />dumpsters, bins, or other solid waste containers or apparatus prior to 8:00am or after <br />8:00pm. <br /> <br />6. Loading and deliveries for the convenience market shall comply with condition no. 7 of <br />Ordinance No. 866, which reads as follows: <br /> <br />"That loading and deliveries for all buildings in the commercial portion be restricted to between the hours <br />of7:00 A.M. and 9:00 P.M. except that these hours may be modified by the City Council if, after <br />appropriate notice, it is determined that such modification is needed to protect the public health, safety, and <br />welfare. II <br /> <br />7. A Planned Unit Development modification shall be required to create a storefront area <br />along the east (rear) elevation of the 2,215 sq. ft. remainder tenant space. <br /> <br />8. Exterior building and parking space modifications for the Bonfare Market shall require <br />separate design review approval. <br /> <br />9. No business signs are approved as part of this application. Business signs shall conform <br />to the existing approved sign program for this building. <br />
