<br />12. The developer shall record CC&R's at the time of recordation of the final map which <br />shall create a property owners association for the development. The CC&R's shall be <br />subject to the review and approval of the City Attorney prior to recordation of the final <br />map. The property owners association shall be responsible for implementing all storm <br />water measures and for the maintenance of all private streets, private utilities, and other <br />common areas and facilities on the site, including all landscaping and soundwalls <br />extending to the face of curb. Landscaping shall be designed with efficient irrigation to <br />reduce runoff, promote surface filtration, and minimize the use of fertilizers, herbicides, <br />and pesticides which can contribute to storm water runoff pollution. <br /> <br />13. The developer shall provide all buyers with copies of the project conditions of approval. <br /> <br />14. The developer shall provide automatic opening sectional roll-up garage doors throughout <br />the project, as approved by the Director of Building Inspection and Planning Director. <br /> <br />I. PUBLIC INFRASTRUCTURE IMPROVEMENTS REQUIRED BY THE <br />STONERIDGE DRIVE SPECIFIC PLAN <br /> <br />15. The developer shall participate in the construction/funding of the public infrastructure <br />improvements identified in Case SPA-95-0l and the Specific Plan Amendment ErR, and <br />as indicated in the table, Comparison of Current SDSP Improvements, Amended SDSP <br />Improvements, and K&Bs Improvement Contributions, Column 5. Should the developer <br />construct all improvements as proposed, the developer shall be eligible for a credit as <br />indicated in Column 6 of said table. <br /> <br />These improvements in brief include El Charro Road, as indicated in the Final ErR; the <br />El Charro Road/I-580 interchange; the northerly 2 lanes of Stoneridge Drive from the <br />Stoneridge Bridge to El Charro Road; the northerly 2 lanes of the Stoneridge Drive <br />bridge; flood control improvements; payment for the SDSP noise study; and dedication of <br />all right-of-way as necessary and as required by the City Engineer. <br /> <br />16. Should there be funds remaining in the SDSP improvement fund after all identified <br />improvements have been constructed or funded, the residential developer will be eligible <br />for a cost reimbursement for those improvements completed which benefit the SDSP <br />properties but which are not included in the scope of the SDSP improvements such as: <br />the realignment of Friesman Road, flood control improvements performed in the City of <br />Livermore, the Martin Avenue pedestrian bridge, and park improvements above the <br />required 17.3 acres of dedication and improvement. <br /> <br />Case PUD-96-02 <br /> <br />Conditions of Approval <br /> <br />Page B-3 <br />
