<br />Resolution No. PC-97-09 <br />Page 21 <br /> <br />a. The applicant fails to receive gro management approval within 2 1/2 <br />years ofPUD approval, or <br /> <br /> <br />b. Subsequent to such approval, the ap icant allows the growth management <br />approval to lapse. <br /> <br />74. The developer shall fund school facilities necess to off-set this project's reasonably <br />related impacts on the long-term needs for exp ded school facilities to serve new <br />development in Pleasanton. Determination of the ethod and manner of the provision of <br />the funds and/or facilities shall be made by the Plea anton Unified School District and the <br />City, and it may be in addition to the school impac fees required by State law and local <br />ordinance. The present program is described' documents entitled "Cooperation <br />Agreement" and "Flat Fee Agreement." The devel per shall be required to participate in <br />the above-referenced program, as it may be amend , or in any successor program, prior <br />to issuance of any building permit for the project. <br /> <br />75. If the 4.8-acre parcel of land proposed to be reserv d for the Operations Service Center <br />expansion is not acquired by the City, the applic may create 14 single-family lots in <br />that area. The final configuration of these lots shall be subject to review and approval by <br />the Planning Director. <br /> <br />{end} <br />
