i <br /> Proposed newsrack <br /> The City will be responsible for installing the newsracks in the downtown area, and for <br /> routine cleaning and upkeep of the new newsracks as part of the City's regular <br /> downtown maintenance activities. Media owners/servicers will apply to use a space in <br /> the newsrack(s), choosing whether their compartment will allow for free distribution or <br /> require payment with a coin-operated compartment. The City will provide the <br /> compartments for free distribution as part of the newsrack, while any coin-operated <br /> compartments will need to be purchased and operated by the media owner/servicer. <br /> Accordingly, the proposed ordinance amendments also directs the City Manager to <br /> approve and implement an administrative policy regarding the application process for <br /> using the City-owned newsracks. <br /> The City provided notice of the proposed consolidation to the owners of existing <br /> newsrack compartments in the downtown area. Responses to initial staff outreach and a <br /> formal notification letter indicate that four media companies — Embarcadero <br /> Media/Pleasanton Weekly, Independent News, Circulation Management, Inc., and Bay <br /> Area News Group/East Bay Times — are interested in having a compartment in the new <br /> newsracks. Additionally, staff provided notice of the proposed consolidation to the <br /> Pleasanton Downtown Association. The PDA acknowledged the newsrack consolidation <br /> addresses a long-standing maintenance issue and is not opposed to the change, while <br /> also offering its interest in continuing to enhance the downtown streetscape such as <br /> with more benches/seating that would encourage downtown patrons to fully enjoy the <br /> downtown area. <br /> For newsracks located outside of the downtown area, the provisions of the existing <br /> newsrack ordinance (chapter 6.28 of the municipal code) will continue to apply. <br /> Specifically, the ordinance notes that newsracks will be maintained "in a neat and clean <br /> condition and in good repair at all times", and further that newsracks "that have been <br /> damaged or stolen shall be replaced or repaired as soon as is practical, unless the <br /> Page 5 of <br />
