BACKGROUND <br /> Newsracks on public sidewalks are a means of distributing speech that cannot be <br /> wholly prohibited under the First Amendment. However, cities may impose reasonable <br /> restrictions on the time, place or manner of the placement of newsracks. The City's <br /> existing newsrack ordinance (Chapter 6.28 of the Municipal Code, provided in <br /> Attachment 1) regulates privately-owned newsracks citywide, including governing the <br /> permissible types and placement of newsracks. <br /> There are currently five freestanding newsracks located along Main Street in the <br /> Pleasanton downtown area, located at 201 Main Street, 300 Main Street, 624 Main <br /> Street, 855 Main Street, and 900 Main Street. For each of these, the City owns the <br /> newsrack, while individual media companies own, manage and service the individual <br /> newsrack compartments that are inserted into the newsrack. With technology changing <br /> the manner in which people read the news, or advertise for events or services, the five <br /> existing newsracks in the downtown area are no longer in full use, and the <br /> compartments have not been maintained or kept in good repair by the media <br /> owner/servicer, leaving them riddled with clutter, debris, dust, and broken windows. <br /> Photos of the condition of these newsracks with the compartments are provided below. <br /> J <br /> 201 Main Street <br /> Page 2 of 6 <br />
