While this <br />process was established in the ODS adopted by Resolution 23-1386 on May 2, 2023, it is not <br />codified in the PMC. As detailed in Exhibit D, the process outlines the specific application <br />submittal requirements and anticipated review/processing timelines for applicants and will <br />enable staff to provide specific guidance on the submittal/review of development <br />applications/projects, reducing incomplete application submittals. As identified in the ODS and <br />discussed with the Planning Commission and City Council, the process also allows for tiered <br />levels of review, with smaller projects (up to 50 units) subject to compliance review and <br />approval by the Zoning Administrator; and larger projects (51 units and larger) requiring <br />Planning Commission compliance review. Under the Housing Site Compliance review process, <br />projects would be subject to review with the standards set forth in the ODS, related <br />environmental mitigation measure(s), and other applicable objective standards established by <br />the City (in place before the project application was received). <br /> <br />PUBLIC NOTICE <br />Notice of this meeting was sent to property owners and tenants/occupants within 1,000-feet of <br />all the housing opportunity sites identified in the Housing Element as shown in Exhibit F. At the <br />time of the report publication, staff has answered questions posed by Hacienda, but has not <br />received any other public comments. Public comments received after publication of this report <br />will be forwarded to the Commission. <br /> <br />ENVIRONMENTAL ASSESSMENT <br />The City prepared a Program Environmental Impact Report (Program EIR) for the 6th Cycle <br />Housing Element (SCH 2022040091), which was certified by the City Council on January 26, <br />2023. The Program EIR fully analyzed the impacts of the Housing Element, including <br />development of housing on each of the housing opportunity sites subject to the proposed <br />rezonings, at the densities allowed for specific sites by the HOZ; the Program EIR also <br />identifies various mitigation measures to address those impacts. The EIR also contemplates <br />the re-zoning actions called for by Programs 1.1 and 1.4. Therefore, the proposed <br />implementation of Housing Element Programs 1.1 and 1.4 by the proposed actions described <br />in this report are within the scope of the project analyzed in the Program EIR, and no further <br />CEQA review is necessary. <br /> <br />SUMMARY/CONCLUSION <br />Staff recommends the Planning Commission: <br /> <br />1. Find the proposed text amendments and HOZ District rezonings are consistent with the <br />General Plan and specifically, the Housing Element. <br />2. Adopt a resolution recommending approval of Cases P23-0607 and P23-0608, subject to <br />the draft text amendments and zoning unit maps provided in Exhibits B through D. <br />3.
