Find the proposed text amendments and HOZ District rezonings are consistent with the <br />General Plan and the 2023-2031 (6th Cycle) Housing Element and Program Environmental <br />Impact Report (SCH2022040091). <br />2. Adopt a resolution recommending approval of Cases P23-0607 and P23-0608, subject to <br />the draft text amendments and zoning unit maps provided in Exhibits B through D. <br />3. Forward Cases P23-0607 and P23-0608 to the City Council for consideration and decision. <br /> <br />EXECUTIVE SUMMARY <br />The subject applications propose: (1) a Municipal Code Amendment to create a HOZ District; <br />(2) to rezone twenty-one housing opportunity sites identified in the 2023-2031 Housing <br />Element to this District; and (3) a Municipal Code Amendment codifying the ODS Housing Site <br />Compliance review process. The City’s recently adopted Housing Element includes Programs <br />1.1 and 1.4 that require the City to rezone properties and create the new HOZ district in the <br />Municipal Code (PMC) and then apply that zoning and uses under this HOZ district to the <br />twenty-one housing opportunity sites identified in the 2023-2031 Housing Element. <br />Additionally, with adoption of the Objective Design Standards (ODS), the City has recently <br />established a Housing Site Compliance review process; the municipal code amendments <br />included with this agenda report propose to codify this process, such that applicants and staff <br />have specific guidance on the submittal/review of development projects on the housing <br />opportunity sites identified in the 2023-2031 Housing Element. Pursuant to State law, the City <br />is required to complete said actions by January 31, 2024. The amendments to the municipal <br />code and rezonings are now before the Planning Commission for a recommendation to the <br />City Council for final consideration and decision. <br /> <br />BACKGROUND <br />The Housing Element is part of the City’s General Plan. It is a comprehensive statement of the <br />City’s current and future housing needs and proposed actions to facilitate the provision of <br />housing to meet those needs at all income levels. Regular updates to the Housing Element are <br />required by State law. The 6th Cycle Housing Element covers the planning period from 2023- <br />2031. On January 26, 2023, and again on June 20, 2023 (with revisions requested by the <br />state), the City Council adopted the 2023-2031 Housing Element and took related actions. The <br />State Department of Housing and Community Development (HCD) issued a letter of <br />Substantial Compliance on August 25, 2023, an action commonly referred to as “certification” <br />of the Housing Element. Thereafter, on September 19, 2023, the City Council readopted the
