The design of the subdivision or its related improvements will not conflict with <br />easements, acquired by the public at large, for access through or use of property <br />within the proposed subdivision. <br /> <br />There are no existing easements on the project site. This Vesting Tentative Map provides <br />for easements including a public access easement, public service easement and <br />emergency access easement. The design of the subdivision and related improvements <br />does not conflict with the proposed easements. <br /> <br />8. The restriction on approving a tentative subdivision map on land covered by a land <br />conservation contract entered into pursuant to the California Land Conservation Act <br />of 1965 (Williamson Act) is not applicable. <br /> <br />The site is not covered by a land conservation contract, including a Williamson Act contract. <br /> <br />9. The discharge of waste from the proposed subdivision would not result in violation <br />of existing requirements prescribed by the California Regional Water Quality Control <br />Board (RWQCB). <br /> <br />No discharge violation currently exists and sewer capacity is available for this subdivision. <br />The project would not discharge any waste other than domestic sewage and all sewage <br />would be discharged into the city’s sanitary sewer system for ultimate treatment. <br />Stormwater runoff would be collected and conveyed through bio-retention basins located <br />on the north and west sides of the parcel. Urban stormwater runoff is required to meet the <br />City’s RWQCB permit requirements for urban development. <br /> <br />ENVIRONMENTAL ASSESSMENT <br />Pursuant to California Environmental Quality Act (CEQA) Guidelines, (Public Resources Code <br />[PRC] § 21000, et seq.), an Environmental Impact Report (EIR) and a Mitigation Monitoring <br />and Reporting Program (MMRP), was prepared and certified by the City of Pleasanton (City) <br />on January 26, 2023 (City of Pleasanton 2023-2031 (6th Cycle) Housing Element Update <br />Program Final Environmental Impact Report, State Clearinghouse No. 2022040091). <br /> <br />A Consistency Checklist has been prepared pursuant to CEQA Guidelines Section 15183 <br />(Projects Consistent with a Community Plan or Zoning) to determine whether the proposed <br />project requires additional environmental review. The Consistency Checklist is attached to this <br />report as Attachment C. CEQA Guidelines Section 15183 mandates that projects consistent <br />with the development density established by existing zoning, community plan, or general plan <br />policies for which an FEIR was certified (in this case the Housing Element Update FEIR) shall <br />not require additional environmental review, except as might be necessary to examine whether <br />there are project-specific significant effects peculiar to the project or its site. <br /> <br />Section 15183 specifies that examination of environmental effects shall be limited to those <br />effects that: (1) are peculiar to the project or the parcel on which the project would be located, <br />and were not analyzed as significant effects in a prior EIR on the zoning action, general plan, <br />or community plan, with which the project is consistent, (2) are potentially significant off-site
