RESOLUTION NO. PC-2023-15 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RECOMMENDING APPROVAL OF THE APPLICATION OF STONERIDGE <br />PROPERTIES, L.L.C. (SIMON PROPERTY GROUP) TO AMEND THE STONERIDGE <br />SHOPPING CENTER DEVELOPMENT AGREEMENT, GOVERNING AN <br />APPROXIMATELY 362,790- SQUARE-FOOT EXPANSION, TO EXTEND THE TERM <br />FOR ONE ADDITIONAL YEAR, PLUS A POTENTIAL ADDITIONAL ONE YEAR <br />FURTHER EXTENSION, AS FILED UNDER CASE NO. PXX17-0904 <br />WHEREAS, Stoneridge Properties, LLC (Simon Property Group) has applied for a <br />Fifth Amendment to the Development Agreement for the properties at 1008 - 1700 <br />Stoneridge Mall Road for a one (1) year extension of the term to December 2024, plus the <br />additional potential further extension by one year to December 2025 upon administrative <br />determination by the City Manager of owner’s completion of stated milestones, payment <br />of current development impact fees, residential and mixed-use development subject to <br />the January 2023 Objective Design Standards, City approval of any transfer, and owner <br />reimbursement of environmental and consultant costs for Framework development, <br />regarding its approximately 362,790 square foot remaining permitted expansion to the <br />Stoneridge Shopping Center, as filed under Case PXX17- 0904; and <br />WHEREAS, a Supplemental Environmental Impact Report (SEIR) was prepared <br />and certified on January 4, 2012, for the Housing Element update and Climate Action <br />Plan General Plan Amendments and Rezonings that supplemented the Environmental <br />Impact Report (EIR) prepared for the Pleasanton 2005-2025 General Plan, certified in July <br />2009. This SEIR anticipated completion of the subject 362,790 square foot expansion of <br />the Stoneridge Shopping Center. The California Environmental Quality Act (CEQA) <br />specifies that individual development projects that are covered by a previously certified EIR <br />or SEIR are exempt from additional environmental review, therefore there is no additional <br />environmental document regarding this Development Agreement extension is required <br />pursuant to Public Resources Code §21083.3 and CEQA Guidelines §15183; and <br />WHEREAS, on November 8, 2023, the Planning Commission held a duly noticed <br />public hearing on this application and considered all public testimony, agenda report, and <br />related materials, and after consideration adopted Resolution No. PC-2023-15, <br />recommending that the City Council approve the extension. <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br />Pleasanton, based on the entire record of proceedings, including the oral and written <br />agenda reports and all public comment and testimony: <br />Section 1. Recommends that the City Council find that the Fifth Amendment to the <br />Development Agreement is consistent with the General Plan as it extends for <br />one year, plus a potential further one-year extension, the opportunity for a <br />362,790-square-foot expansion of the Stoneridge Shopping Center, subject <br />to the payment of current development impact fees, on property with a <br />General Plan Land Use Designation of Retail / Highway / Service Commercial <br />Business and Professional Offices. <br />Section 2. Recommends that the City Council find that the 362,790-square-foot <br />EXHIBIT A
