PLANNING COMMISSION ACTION
The Planning Commission held a public hearing on August 23, 2023, to review the
project and provide a recommendation to the City Council. Six members of the public,
including the applicant/property owners, spoke providing a mix of supportive and
non-supportive comments. Objections were raised regarding the existing partially built
tennis court fence height, visual impacts, proximity to the adjacent neighbor residence
(3520 Dennis Drive) at the shared side property line to the north, and tennis court
lighting. The applicant/property owners clarified in their public comment they were being
considerate to neighbor impacts and attempted to reach out to the adjacent neighbor.
The outreach effort resulted in the applicant/property owners removing lighting from the
scope of the tennis court project.
The Planning Commission focused its discussion on several items while considering the
project, including but not limited to:
• Staff's communication with the applicants/property owners prior to proceeding
with installation of fence posts
• Tennis court fence height, fence design, and associated lighting
• Tennis court location and setbacks
• Existing tennis courts with and without fencing in the neighborhood.
After public testimony and discussing the project, the Planning Commission requested a
recess to provide an opportunity for the applicants/property owners and concerned
neighbors, specifically adjacent neighbors at 3520 Dennis Drive, to come into a
compromise. The app Iicant/prope rty owners and concerned neighbors proposed to the
commission that the tennis court fence be no more than 10 feet maximum height at the
front and rear ends of the existing tennis court and be no more than 8 feet maximum
height on the long sides of the tennis court up to the service line (see Figure 9 of tennis
court design concept).
Fi ure 9: Tennis Court Fence Design Concept
8 ft. max.fence height Service Line
10 ft, max.
