In its current state, the Tennis Court maintains a side yard setback of 6.5 feet and a rear <br /> yard setback of 14 feet which is well in conformance with the standards provided. <br /> Consequently, we are fully aligned with the regulations provided by the City <br /> Planning department and disagree with their assertion that "partially built sports <br /> court has been constructed without City Approval.". The construction of the Tennis <br /> Court was carried out in accordance with the specified standards. <br /> On December 13t", 2022 we received a call from Code Enforcement stating that the 10 ft <br /> high fence poles are in nonconformance and directed us to contact the Planning <br /> Department. Since then, the Planning Department has changed their position and we <br /> have been put on this new path requiring the filing of this PUD. <br /> Once we learned that our neighbors (3520 Dennis Dr.) have expressed concerns about <br /> the Tennis Court, we have made consistent efforts to reach out to them evite invitation, <br /> text and driveway intercept. To summarize, the neighbors listened, but refused to discuss <br /> any options including landscaping, additional screens, fence height changes between the <br /> properties, or other hiding methods. The last communication from them on February 24tH <br /> 2023 is "We are still waiting to hear back from the city before we discuss any other <br /> options". The text message conversations with the neighbor have been enclosed and can <br /> be found in Exhibit C. <br /> Based on the above sequence of events, we have following questions: <br /> 1. Is the development standard recommended by staff for the Sports Court exclusively <br /> for our property, or will it be uniformly applied throughout the City of Pleasanton? If the <br /> Planning Staff recommends changing the PMC setbacks for all sports courts (tennis, <br /> pickle ball, basketball, etc) in Pleasanton, existing courts should be grandfathered. <br /> 2. If these sports court development standards apply only to our property, what distinct <br /> characteristics set our property apart from others that necessitate these specific <br /> development standards? Within our neighborhood, at least four other properties <br /> already have tennis courts, their presence evident via Google Earth imagery. Certain <br /> instances also feature visible fence and light installations. To the best of our <br /> knowledge, none of these properties have secured permits for the installation of lights <br /> or fences. Page 3 of the Agenda Report: "The Planning Division determined the appropriate <br /> course of action would be to require the applicant/property owners to apply for a PUD <br /> development plan that would establish development standards for the subject parcel". <br /> What factors lead staff to the conclusion that a development plan is necessary <br /> for an otherwise conforming sports court? <br /> Page 4 of 18 <br />
