EXHIBIT B <br /> Background: We, the current owners, purchased this property in April 2022 and have been using this <br /> property as our primary residence since then. In August 2022, we reached out to Pleasanton City to seek <br /> approval for building a tennis court along with a 10ft high sports court fencing and 12ft high LED lights in <br /> our back yard.The city gave us the go ahead for the Tennis Court with sport court fencing however we <br /> were asked to submit an application for administrative design review to secure planning permit for the <br /> lights. <br /> Subsequently we undertook the construction of the proposed Tennis Court and the sports court fencing <br /> (without LED lights). We also applied for planning permit for LED lights. By early December 2022, the flat <br /> work for the tennis court was fully completed and we put in the poles for the sport court fencing(The <br /> chain link had not been put in yet). <br /> On or around December 101h 2022, we received a call from City Enforcement that our neighbour had <br /> complained about the tennis court and we were directed to contact the city. On further discussions with <br /> the city, we have been directed to submit this application. <br /> We had built the sports court based on following two email communications from Planner on Duty <br /> Email dated November 9th, 2022 by Planner on Duty:<Quote Begin> "The property is zoned PUD-LDR <br /> and subject to the R-1-20,000 development standards. Per the R-1-20,000 standards, accessory <br /> structures are required to be setback 5-feet from the rear setback line and 3-feet from the side property <br /> line (see Table 18.84.010)." <Quote End> <br /> Email dated August 22nd,2022 by Planner on Duty:<Quote Begin> "The tennis court would not require <br /> any Planning review or permits.The same for the 10-foot-high fence from a Planning perspective, but <br /> again it cannot exceed 10 feet at any point. A Building permit would be required for the fence." <Quote <br /> End> <br /> Proposal: We are proposing to go with the development standards of an established zone (R-1-40,000) <br /> with specific sport courts fencing standards. <br /> The sports court fencing will have maximum height of 10 ft with other standards as follows: <br /> • Minimum Side Setback of 6 ft from side boundary of the property. <br /> • Minimum Rear Setback of 10 ft from rear boundary of the property. <br /> • Maximum sport court fence height of 10 ft <br /> • Sports court will be in the backyard and will not be in the front yard of the house. <br /> • The fencing screen will be chain link fence <br />
