4 <br /> THE CITY OF <br /> iftlik'' CITY COUNCIL AGENDA REPORT <br /> PLEASANTON, <br /> September 19, 2023 <br /> Community Development <br /> TITLE: APPROVE A SECOND AMENDMENT TO THE PROFESSIONAL SERVICES <br /> AGREEMENT WITH FIRST CARBON SOLUTIONS, EXTENDING THE TERM <br /> AND AUGMENTING THE SCOPE AND COMPENSATION BY $84,578 FOR <br /> ADDITIONAL REQUIRED ENVIRONMENTAL REVIEW, FOR A REVISED <br /> NOT-TO-EXCEED TOTAL CONTRACT AMOUNT OF $346,594 AND <br /> APPROVE A NEW REIMBURSEMENT AGREEMENT WITH PONDEROSA <br /> FOR THESE SERVICES IN A COMMENSURATE AMOUNT, RELATED TO <br /> THE PROPOSAL OF 30 SINGLE-FAMILY DETACHED HOMES, <br /> ASSOCIATED IMPROVEMENTS, AND LAND DEDICATION ON THE <br /> LESTER AND PONDEROSA PROPERTIES <br /> SUMMARY <br /> Staff requests approval of an amendment to the Professional Services Agreement (PSA) <br /> with First Carbon Solutions (FCS), the firm preparing the EIR for Ponderosa's <br /> development applications. In addition, staff requests approval of a new, related <br /> reimbursement agreement with Ponderosa Homes to reimburse the City for the cost of <br /> the EIR work. The PSA and initial reimbursement agreement were approved by the City <br /> Council in September 2018; however, environmental work did not begin until 2019, after <br /> new California Environmental Quality Act (CEQA) guidelines took effect. The PSA <br /> needed to be amended to address and analyze the added environmental topics. The first <br /> amendment to the PSA was approved by the City Council in September 2019, and <br /> although FCS began work on the EIR the development applications were put on hold in <br /> 2020 due to the pandemic and later due to the four subject properties being included in <br /> the City's Housing Element Update (HEU). With the HEU complete, City and FCS staff <br /> can reinitiate work on the project. If approved, the proposed second amendment to the <br /> PSA would bring the contract total to a not-to-exceed amount of $346,594, which <br /> includes the previously established 15 percent contingency on the original contract <br /> amount (contingency amount of$28,976). <br /> RECOMMENDATION <br /> 1. Authorize the City Manager to execute a second amendment to the PSA with FCS, <br /> updating the scope of work, extending the term, and adding compensation in the <br /> amount of $84,578, for a revised total not-to-exceed contract amount of $346,594 <br /> (including the $28,976 contingency) for continued services related to the EIR <br /> preparation (Attachment 1), subject to minor modifications approved by the City <br /> Manager and City Attorney. <br /> 2. Authorize the City Manager to execute a new Reimbursement Agreement with <br /> Ponderosa Homes for reimbursement of all costs associated with the PSA with FCS, <br />
