Attachment 3 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> READOPTING THE 2023-2031 (6TH CYCLE)HOUSING ELEMENT OF THE GENERAL <br /> PLAN IN COMPLIANCE WITH STATE HOUSING ELEMENT LAW <br /> WHEREAS, the City Council re-adopts the chronology recitals set forth in Resolution No. <br /> 23-1406 regarding the adoption of the amended Housing Element on June 20, 2023; and <br /> WHEREAS, Resolution No. 23-1406 Section 7 delegated authority to the City's Director of <br /> Community Development to file all necessary materials with the California Department of Housing and <br /> Community Development (HCD) in order for HCD to find that the Housing Element is in conformance <br /> with State Housing Element Law and further directed and authorized the director to make all typographical <br /> and non-substantive changes to the Land Use Element and Housing Element to make them internally <br /> consistent or to address any non-substantive changes or amendments(collectively revisions)requested by <br /> HCD to achieve HCD certification of the Housing Element; and <br /> WHEREAS,the director and City staff made typographical fixes, added clarifying language, and <br /> highlighted programs affirmatively furthering fair housing to comply with state housing law and provide <br /> for increased marketing of information and resources (collectively the revisions), then posted those <br /> revisions on August 17, 2023; and <br /> WHEREAS, on August 25,2023, HCD provided the City a letter finding that the City's Housing <br /> Element, with the revisions, is in substantial compliance with state housing law; and <br /> WHEREAS, on September 19, 2023, the City Council conducted a duly and properly noticed <br /> public hearing, received public comment, reviewed the revisions to the Housing Element by the Director <br /> of Community Development which were posted for public review on August 17,2023,and determined the <br /> Housing Element to be consistent with State law and the General Plan of the City. <br /> NOW, THEREFOREā€ž THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE,DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the foregoing recitals are true and correct and are incorporated by <br /> reference to this action. <br /> SECTION 2. Finds that the non-substantive changes and amendments (collectively the <br /> "revisions") to the Housing Element remain consistent with the scope of the project analyzed in the <br /> previously certified Program EIR Housing Element adopted by City Council Resolution No. 23-1357 and <br /> that no further environmental analysis is required per Title 14 California Code of Regulations§15168(c)(2). <br /> SECTION 3. Finds that the Housing Element, as modified by the revisions, complies with <br /> Housing Element Law, as provided in California Government Code §65580 et. seq. and contains all <br /> provisions required by State Housing Element Law, and as previously enumerated in Exhibit A2 to City <br /> Council Resolution No. 23-1358. <br /> SECTION 4. Readopts the findings regarding substantive evidence in the record regarding non- <br /> vacant higher density RHNA sites as set forth in Resolution No. 23-1406 Section 4. <br />
