This approval does not guarantee the availability of sufficient water to serve the project. <br />The City shall withhold building permits for the project if at the time building permits are <br />applied for, mandatory water rationing is in effect, unless the City has adopted a water <br />offset program and unless the project developer is participating in the program. <br />Notwithstanding the project developer's participation in such a program, the City may <br />withhold building permits if the City determines that sufficient water is not available at <br />the time of application of building permits. <br /> <br />The building permit plan check materials will be accepted for submittal only after the <br />City Council's introduction of the ordinance covering this development plan. The plan <br />check materials will be accepted before the effective date of the ordinance only if the <br />project developer submits a signed hold-harmless statement acknowledging that the City <br />is not responsible for the plan check fees nor for the costs associated with the building <br />permit plan preparation in the event that Council approval is rescinded. In no case will <br />the City issue a building permit until the effective date of the ordinance approving the <br />project. <br /> <br />Planning Requirements: <br /> <br />10. <br /> <br />The project is limited to a maximum of 12 fuel dispensers, defined as the number of <br />individual hose/nozzle combinations. The dispensers can include any combination of <br />gasoline and/or diesel fuel. Any request for an increase in the number of fuel dispensers <br />shall be submitted as an application for design review approval and shall be accompanied <br />by an analysis of traffic irnpacts based upon the proposed number of dispensers. <br /> <br />11. <br /> <br />The project developer shall submit a maintenance program for the perimeter swale areas <br />to ensure its continued function as a filter area for stormwater runoff. The maintenance <br />program shall be submitted with the building permit application and shall be subject to <br />review and approval by the Planning Director and by the City Engineer before issuance <br />of a building permit, and shall be identified in the parcel's title via a deed restriction <br />recorded prior to occupancy. Wording for the deed restriction shall be submitted to the <br />City Attorney for review before its recordation. <br /> <br />12. Signage for this project shall be limited to the following: <br /> <br />One, nine-foot tall, three-sided monument identification/price sign located on the <br />comer of Utah Street and Bemal Avenue. Only two sides of this sign may have <br />sign copy. The monument sign may include the "Pleasanton U.S. Gas" name and <br />logo and fuel prices, and shall be stone-veneered to match the convenience market <br />and finished with a cornice along its top-edge. The sign copy shall be composed <br />of routed-out lettering on an opaque background or bas-relief letters mounted on <br />an opaque panel. Bas-relief lettering may be indirectly illuminated. The fuel <br />prices shall be reduced to the minimum size allowed by law with the resultant <br />overall height of the monument sign reduced correspondingly. <br /> <br />2 <br /> <br /> <br />
