CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> AI,AMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-080 <br /> <br />RESOLUTION APPROVING A NEGATIVE DECLARATION FOR THE <br />APPLICATION OF FAIRLAND INVESTMENT, INC. FOR DESIGN REVIEW <br />APPROVAL, CONDITIONAL. USE PERMIT, AND MODIFICATION TO THE <br />STANLEY BUSINESS PARK PUD DEVELOPMENT PLAN, AS FILED UNDER CASE, <br />PDR-289/PCUP-86/PUD-81-25-6M <br /> <br />WHEREAS, <br /> <br />at its meeting of October 19, 2004, the City Council received a proposed Negative <br />Declaration for the application of Fairland Investment, Inc. for design review <br />approval and conditional use permit approval of a self-service gasoline station on <br />an approximately 1.25-acre site located at 3121 Bemal Avenue and 3581 Utah <br />Street consisting of eight fuel pump dispensers, a drive-through carwash, a <br />3,600-square-foot convenience market, and a modification to the Stanley Business <br />Park PUD development plan to allow alcoholic beverage sales from the <br />convenience market; and <br /> <br />WHEREAS, <br /> <br />the City Council received and reviewed the Initial Study, dated September 8, <br />2004, and received the recommendations of the staff and Planning Commission; <br />and <br /> <br />WHEREAS, <br /> <br />a duly noticed public hearing was held on October 19, 2004, at which time the <br />public was given the opportunity to comment on the environmental impacts of the <br />proposed project; and <br /> <br />WHEREAS <br /> <br />the City Council has reviewed the potential impacts in accordance with the <br />applicable state and local guidelines governing the preparation of Negative <br />Declarations and Environmental Impact Reports; and <br /> <br />WHEREAS the City Council finds that the proposed project would not have any significant <br /> adverse effects on the environment; and <br /> <br />WHEREAS the City Council further finds that the proposed project will have no potential for <br /> adverse impacts on the site's wildlife. <br /> <br /> <br />
