P23-0389; 6668 Owens Drive Planning Commission <br />6 of 7 <br />Engineering Division has recommended a condition of approval requiring all parents/guardians <br />to park in an available parking space when dropping off or picking up students. Double <br />parking, parking in drive aisles, and curbside drop-off and pick-up would be prohibited. <br /> <br />Parking <br />There are 50 parking spaces on-site shared with the existing martial arts studio on the first <br />floor. Based on the martial arts studio’s current schedule, its classes start at 4p.m. when the <br />proposed instructional facility concludes at 3:30 p.m. The martial art studio’s morning sessions <br />conclude at 8:45 a.m. when classes at the proposed facility start at 9:15 a.m. The offsetting <br />schedules of the existing tenant and the incoming tenant if the CUP is approved help avoid <br />parking lot congestion. <br /> <br />To ensure the proposed instructional facility would not cause parking issues, staff has included <br />a condition of approval which allows the Director of Community Development to refer the use <br />permit back to the Planning Commission for possible mitigation measures should <br />issues/concerns are brought to staff’s attention. Possible mitigating conditions could include <br />reducing the number of students and/or modifying the arrival/departure times. <br /> <br />Maximum Occupancy and Duration <br />The Fire Marshal of Livermore-Pleasanton Fire Department (LPFD) visited the project site. <br />Given the existing two-story building is not equipped with an automatic fire suppression <br />system, the proposed instructional facility is for students in grades K-8th and is on the second <br />floor of the building, the Fire Marshal requires the following: <br /> <br /> A fire alarm system to be installed, inspected, and approved by LPFD prior to <br />occupancy; <br /> The maximum occupancy at the facility be capped at 49 people, a total number of <br />students, teachers/staff, and visitors combined; and <br /> The maximum duration for the proposal facility to occupy the facility without an <br />automatic sprinkler system is 2 years from the date of the occupancy. <br /> <br />Staff has included these requirements as conditions of approval. <br /> <br />ALTERNATIVES <br />As outlined in the above analysis staff believes the use, as proposed and conditioned, would <br />be compatible with the other uses in the vicinity and not create adverse impacts, and <br />recommends the Planning Commission approve the project as proposed and conditioned. <br />However, alternatives to the proposal could be considered by the Planning Commission <br />include: <br /> <br />1. Approval of the proposal subject to the recommended conditions of approval; or <br />2. Denial of the proposal; or <br />3. Approval of the proposal with modified hours, number of tutoring sessions, number of <br />students, etc. <br /> <br />PUBLIC NOTICE AND COMMENTS <br />Notices of this application were sent to surrounding property owners and tenants within a <br />1,000-foot radius of the site. At the time this report was published, staff has not received any <br />public comments about the project.
