BACKGROUND <br /> At its April 18, 2023, meeting, the City Council approved the City's draft Annual Action <br /> Plan for FY 2023/24 which included the allocation of$250,000 in federal CDBG funds to <br /> the Tri-Valley Haven's Emergency Shelter Rebuild project. On May 16, 2023, the City <br /> Council also approved the Memorandum of Understanding with the City of Livermore to <br /> designate Livermore as the lead agency for the environmental review for the project. <br /> Since both Livermore and Pleasanton allocated federal CDBG funds to the project, it is <br /> subject to the CDBG environmental regulations of the U.S. Department of Housing and <br /> Urban Development (HUD) contained in 24 Code of Federal Regulations (CFR) Part 58. <br /> The environmental review consultant, Raney Planning and Management, Inc., has <br /> already begun the environmental assessment process. <br /> DISCUSSION <br /> The City of Dublin and the Alameda County Housing and Community Development <br /> (County of Alameda) staff recently communicated with Livermore and Pleasanton staff <br /> to request to be added as cooperating agency entities to the MOU. The County of <br /> Alameda is a grant recipient for the "Urban County" CDBG Grant, which includes the <br /> five small cities of Albany, Emeryville, Piedmont, Newark, and Dublin, in the county and <br /> in the unincorporated areas of the county. Because Dublin has also recommended <br /> federal CDBG funding for the project, both Dublin and County of Alameda as the CDBG <br /> grant recipients are also required to complete the environmental review for the project. <br /> HUD has confirmed that its environmental regulations permit multiple CDBG entitlement <br /> jurisdictions to enter into an MOU to allow them to collaborate in completing a single <br /> environmental review for the CDBG-funded project. Consequently, the Tri-Valley Cities <br /> of Dublin, Livermore, and Pleasanton, as well as the County of Alameda, all support <br /> entering into an MOU, with Livermore designated as the lead agency for the <br /> environmental review since the project is located in Livermore. To do so, the <br /> Amendment to the MOU (Attachment 1) would formally add the County of Alameda and <br /> the City of Dublin as cooperating agency entities.
