Resolution No. 23-1406 <br /> Page 2 of 3 <br /> SECTION 3. The City Council finds that the that the Land Use Element and Housing <br /> Element, as revised, comply with Housing Element Law, as provided in Government Code §65580 <br /> et seq and contains all provisions required by State Housing Element Law, and as previously <br /> enumerated in Exhibit A2 to City Council Resolution No. 23-1358. <br /> SECTION 4. The City Council finds that based on substantial evidence in the record <br /> including that non-vacant higher density RHNA sites are primarily underutilized as surface parking <br /> and/or surface parking with commercial buildings where the existing uses are of marginal economic <br /> viability, the structures are at or near the end of their useful life, and the City has received affirmative <br /> interest in developing housing, the existing uses on the non-vacant sites identified in the site <br /> inventory to accommodate the RHNA are likely to be discontinued during the planning period and <br /> therefore do not constitute an impediment to planned residential development on the sites during the <br /> planning period, as described more particularly in Exhibit C to this resolution, incorporated herein by <br /> this reference and further enumerated in Exhibit A3 of City Council Resolution No. 23-1358; except <br /> that the reference to the Kaiser site on Exhibit A3 page 3, paragraph 3, is excluded from such <br /> incorporation. <br /> SECTION 5. The City Council finds that the Housing Element incorporates the City's goals, <br /> quantifiable objectives, and policies to affirmatively further fair housing and the maintenance, <br /> preservation, improvement, and development of housing per Government Code §65583(b). <br /> SECTION 6. The City Council adopts the General Plan amendments to the Land Use <br /> Element (Exhibit A) and Housing Element (Exhibit B) that have been modified in response to the <br /> findings of HCD, to remove the Kaiser site in response to current owner intent, and to add the Boulder <br /> Street site, as being in substantial compliance with the requirements of State Housing Element Law, <br /> as previously enumerated in Exhibit A2 to City Council Resolution No. 23-1358. <br /> SECTION 7. The Director of Community Development or designee is hereby directed to file <br /> all necessary material with HCD for HCD to find that the Housing Element is in conformance with <br /> State Housing Element Law and is further directed and authorized to make all typographical and <br /> non-substantive changes to the Land Use Element and Housing Element to make them internally <br /> consistent or to address any non-substantive changes or amendments requested by HCD to achieve <br /> HCD certification of the Housing Element. <br /> SECTION 8. The Director of Community Development or designee is hereby directed to <br /> distribute copies of the Housing Element in the manner provided in Government Code §§65357 and <br /> 65589.7. <br /> SECTION 9.
