RESOLUTION NO. 23-1406 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING <br /> THE ADOPTED LAND USE ELEMENT AND THE 2023-2031 (6T" CYCLE) HOUSING <br /> ELEMENT OF THE GENERAL PLAN IN COMPLIANCE WITH STATE HOUSING <br /> ELEMENT LAW <br /> WHEREAS, on January 26, 2023, the City Council adopted Resolution No. 23-1358 Adopting <br /> a General Plan Amendment to Update the Housing Element for the Period of 2023-2031 (6th Cycle) <br /> Affirmatively Furthering Fair Housing in Compliance with State Housing Element Law, and the City <br /> Council readopts by reference the recitals in that resolution; and <br /> WHEREAS, on February 14, 2023, the City submitted the adopted Housing Element to the <br /> California Department of Housing and Community Development (HCD) for review and certification; <br /> and <br /> WHEREAS, on April 10, 2023, HCD provided a comment letter to the City; and <br /> WHEREAS, on May 10, 2023, the Planning Commission conducted a duly and properly <br /> noticed public hearing, reviewed the City's response to HCD's comments, and reviewed the <br /> proposed modifications to the adopted Land Use Element and Housing Element; determined the <br /> Housing Element to be consistent with State law and the General Plan of the City; and recommended <br /> adoption by the City Council; and <br /> WHEREAS, on June 6, 2023, the City Council received a public comment from the property <br /> owner for the Kaiser Site (APN 941-120105203) requesting removal of the site from the Housing <br /> Element. There was previously stated interest in redevelopment of this site from the property owner, <br /> that resulted in the site's inclusion in the 4th Cycle Housing Element. However, given the more recent <br /> letter received, this site will not be counted among those included in the City's sites inventory towards <br /> meeting the RHNA in the 6th Cycle Housing Element; and <br /> WHEREAS, with removal of the Kaiser site from the inventory, the City's Regional Housing <br /> Needs Assessment (RHNA) is still being met. However, to increase the low-income unit buffer, Area <br /> 20 (Boulder Street) is being added into the 6th Cycle Housing Element. Area 20 was previously <br /> reviewed through the public process and evaluated through the California Environmental Quality Act <br /> (CEQA); and <br /> WHEREAS, on June 20, 2023, the City Council conducted a duly and properly noticed public <br /> hearing, received public comment, reviewed the City's response to HCD's comments, and reviewed <br /> the proposed modifications to the adopted Land Use Element and Housing Element; and determined <br /> the Housing Element to be consistent with State law and the General Plan of the City. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the foregoing recitals are true and correct and are incorporated by <br /> reference into this action. <br /> SECTION 2. Finds that the modifications to the Land Use Element and Housing Element <br /> remain consistent with the scope of the project analyzed in the previously certified Program EIR <br /> Housing Element adopted by City Council Resolution No. 23-1357 and that no further environmental <br /> analysis is required per Title 14 California Code of Regulations §15168(c)(2). <br />
