B. Regularly Scheduled Membership Meetings. <br /> 1. Union meetings may be held in fire stations after 1700 hours unless other <br /> arrangements have been authorized in advance by the Fire Chief. <br /> 2. Union meetings shall not interfere with regularly scheduled duties or emergency <br /> response. Fire prevention personnel may attend union meetings during their <br /> regular work hours provided they are otherwise able to complete their duties. <br /> 3. On-duty members may attend Union meetings as long as no first-due districts <br /> are left empty or by approval of the Fire Chief. <br /> C. Advance Notice <br /> Except in cases of emergency, the Union shall be given reasonable advance written <br /> notice of any ordinance, resolution, rule or regulation relating to matters within the <br /> scope of representation and shall be given the opportunity to meet and confer in good <br /> faith with the appropriate management representatives prior to adoption. <br /> The Department will provide the Union with reasonable written notice and the <br /> opportunity to meet and confer in good faith regarding the addition to or changes in <br /> Personnel Rules and Regulations, other policies, or departmental policies when such <br /> changes are within the scope of bargaining pursuant to the MMBA. <br /> Section 3. No Discrimination <br /> The Employer and the Union shall comply with the City of Pleasanton's Harassment, Discrimination, <br /> and Retaliation Policy (Human Resources&Administrative Policy Guide). <br /> Furthermore, the Employer shall not discriminate or retaliate against any employee because of their <br /> engagement in legally protected Union activities. <br /> Section 4. Union Representatives <br /> Bargaining unit employees who are officers or official representatives of the Union shall be given <br /> reasonable time off with pay to attend meetings with management representatives, or to be present at <br /> hearings where matters within the scope of representation are being considered. The use of official <br /> time for this purpose shall be reasonable and shall not interfere with the performance of department <br /> services as determined by the Department. Such employee representatives shall submit requests for <br /> excused absences to the Fire Chief. The Union shall submit a list of the officers of the Union to the <br /> Fire Chief in writing at such time there are any changes in such Union officers. <br /> Section 5. Salaries <br /> 5.1 Salary Ranges and Salary Increases for Contract Term <br /> Salary ranges have been established for Battalion Chiefs. For all current Battalion Chiefs at the time <br /> of the effective date of MOU, movement through the range will be five percent (5%) based on an <br /> annual performance review rating of at least "meets expectations" by the Fire Chief on July 1 each <br /> year and up to an additional two percent (2%) based on recommendation of Fire Chief and approval <br /> by the City Manager. For all Battalion Chief s promoted after the effective date of the MOU, <br /> movement through the range will be five percent(5%)based on an annual performance review rating <br /> of at least "meets expectations" by the Fire Chief and up to an additional two percent (2%) based on <br /> 4894-5387-2224 v2 6 <br />
