Resolution No. <br /> Page 2 of 3 <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> Section 1. Finds that the foregoing recitals are true and correct and are incorporated <br /> by reference into this action. <br /> Section 2. Finds that the modifications to the Land Use Element and Housing Element <br /> remain consistent with the scope of the project analyzed in the previously <br /> certified Program EIR Housing Element adopted by City Council <br /> Resolution No. 23-1357 and that no further environmental analysis is <br /> required per Title 14 California Code of Regulations §15168(c)(2). <br /> Section 3. The City Council finds that the that the Land Use Element and Housing <br /> Element, as revised, comply with Housing Element Law, as provided in <br /> Government Code §65580 et seq and contains all provisions required by <br /> State Housing Element Law, and as previously enumerated in Exhibit A2 <br /> to City Council Resolution No. 23-1358. <br /> Section 4. The City Council finds that based on substantial evidence in the record <br /> including that non-vacant higher density RHNA sites are primarily <br /> underutilized as surface parking and/or surface parking with commercial <br /> buildings where the existing uses are of marginal economic viability, the <br /> structures are at or near the end of their useful life, and the City has <br /> received affirmative interest in developing housing, the existing uses on <br /> the non-vacant sites identified in the site inventory to accommodate the <br /> RHNA are likely to be discontinued during the planning period and <br /> therefore do not constitute an impediment to planned residential <br /> development on the sites during the planning period, as described more <br /> particularly in Exhibit C to this resolution, incorporated herein by this <br /> reference and further enumerated in Exhibit A3 of City Council Resolution <br /> No. 23-1358; except that the reference to the Kaiser site on Exhibit A3 <br /> page 3, paragraph 3, is excluded from such incorporation. <br /> Section 5. The City Council finds that the Housing Element incorporates the City's <br /> goals, quantifiable objectives, and policies to affirmatively further fair <br /> housing and the maintenance, preservation, improvement, and <br /> development of housing per Government Code §65583(b). <br /> Section 6. The City Council adopts the General Plan amendments to the Land Use <br /> Element (Exhibit A) and Housing Element (Exhibit B) that have been <br /> modified in response to the findings of HCD, to remove the Kaiser site in <br /> response to current owner intent, and to add the Boulder Street site or <br /> alternatively the Old Santa Rita Road site, as being in substantial <br /> compliance with the requirements of State Housing Element Law, as <br /> previously enumerated in Exhibit A2 to City Council Resolution No. 23- <br /> 1358. <br />
