ATTACHMENT 3 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING THE ADOPTED LAND USE ELEMENT AND THE 2023-2031 (6T" <br /> CYCLE) HOUSING ELEMENT OF THE GENERAL PLAN IN COMPLIANCE <br /> WITH STATE HOUSING ELEMENT LAW <br /> WHEREAS, on January 26, 2023, the City Council adopted Resolution No. 23- <br /> 1358 Adopting a General Plan Amendment to Update the Housing Element for the Period <br /> of 2023-2031 (6th Cycle) Affirmatively Furthering Fair Housing in Compliance with State <br /> Housing Element Law, and the City Council readopts by reference the recitals in that <br /> resolution; and <br /> WHEREAS, on February 14, 2023, the City submitted the adopted Housing <br /> Element to the California Department of Housing and Community Development (HCD) <br /> for review and certification; and <br /> WHEREAS, on April 10, 2023, HCD provided a comment letter to the City; and <br /> WHEREAS, on May 10, 2023, the Planning Commission conducted a duly and <br /> properly noticed public hearing, reviewed the City's response to HCD's comments, and <br /> reviewed the proposed modifications to the adopted Land Use Element and Housing <br /> Element; determined the Housing Element to be consistent with State law and the <br /> General Plan of the City; and recommended adoption by the City Council; and <br /> WHEREAS, on June 6, 2023, the City Council received a public comment from the <br /> property owner for the Kaiser Site (APN 941-120105203) requesting removal of the site <br /> from the Housing Element. There was previously stated interest in redevelopment of this <br /> site from the property owner, that resulted in the site's inclusion in the 4th Cycle Housing <br /> Element. However, given the more recent letter received, this site will not be counted <br /> among those included in the City's sites inventory towards meeting the RHNA in the 6th <br /> Cycle Housing Element; and <br /> WHEREAS, with removal of the Kaiser site from the inventory, the City's Regional <br /> Housing Needs Assessment (RHNA) is still being met. However, to increase the low- <br /> income unit buffer, Area 20 (Boulder Street) or alternatively, Area 11 (Old Santa Rita <br /> Road) is being added into the 6th Cycle Housing Element. Area 20 and Area 11 were <br /> previously reviewed through the public process and evaluated through the California <br /> Environmental Quality Act (CEQA); and <br /> WHEREAS, on June 20, 2023, the City Council conducted a duly and properly <br /> noticed public hearing, received public comment, reviewed the City's response to HCD's <br /> comments, and reviewed the proposed modifications to the adopted Land Use Element <br /> and Housing Element; and determined the Housing Element to be consistent with State <br /> law and the General Plan of the City. <br />
