L1VEBNJ®RE <br /> CALIFORNIA COMMENT COMPILATION AND RESPONSE <br /> This report conveys public/stakeholder comments and the corresponding Airport staff response <br /> regarding the draft Leasing and Development Policy (Policy)for Livermore Municipal (Airport). The <br /> City of Livermore (City) believes that the proposed Policy sets forth thoughtful and deliberate <br /> processes and procedures to evaluate, approve, or reject proposals related to the leasing and/or <br /> development (including construction, modification, and/or renovation) of aeronautical and non- <br /> aeronautical land and/or Improvements within the legal boundaries of the current Airport Layout Plan <br /> for the Airport. The proposed Policy establishes leasing protocols and requirements for attractive, <br /> high-quality, consistent, compatible, and sustainable development that protects persons and property <br /> with an over-arching goal of improving the Airport for the betterment of the City, Airport Tenants, <br /> Airport users, and the community. <br /> It is the goal of the City to ensure Airport property is leased and developed in a high-quality manner <br /> consistent with sound fiscal management and best practices while ensuring the provision of essential <br /> infrastructure, Improvements, and amenities. Additionally, the proposed Policy reflects Airport <br /> Development Priorities established by the Livermore City Council in 2010 through resolution number <br /> 2010-058. Resolution 2010-058, will be used as criteria for evaluating all proposals. <br /> The proposed Policy is consistent with established City policies, compliant with Federal Aviation <br /> Administration (FAA) Airport Sponsor Assurances, and effectively guides the management of <br /> proposals related to the leasing and/or development of aeronautical and non-aeronautical land and/or <br /> Improvements at the Airport. <br /> By way of background, when an airport sponsor (in this case, the City of Livermore) obtains a grant <br /> for airport improvements under the Airport Improvement Program. the airport sponsor is required to <br /> give certain assurances to the FAA known as the Airport Sponsor Assurances(currently comprised of <br /> thirty-three assurances). Airport Sponsor Assurance #22, Economic Nondiscrimination, states "The <br /> sponsor may establish such reasonable, and not unjustly discriminatory, conditions to be met by all <br /> users of the airport as may be necessary for the safe and efficient operation of the airport." <br /> Federal obligations under Grant Assurance 23, Exclusive Rights, prohibits the City from granting an <br /> exclusive right for the use of the airport, including granting an exclusive right to any person or entity <br /> providing or intending to provide commercial aeronautical services to the public. In particular, the <br /> City may not grant a special privilege or a monopoly to an entity currently providing aeronautical <br /> services based at the Airport. The intent of this restriction is to promote aeronautical activity and <br /> protect fair competition. <br /> Beyond being consistent with FAA policies and directives, the City believes that this Policy is <br /> consistent with best management practices. It is not the desire or the intent of the City to create an <br /> undue burden on existing or future operators/tenants, but to provide a comprehensive and deliberative <br /> process that is fair and not unjustly discriminatory. <br /> Comment Compilation and Response - 1 <br /> City of Livermore, Livermore Municipal Airport(06/05/2023) <br />
