specially benefitted by construction proposed in a plan of control approved by the <br /> legislative body and (2) the assessments were previously approved by all property <br /> owners at the time the assessment was created. Since these criteria have been <br /> satisfied, the GHAD assessments can be increased by an amount not exceeding the <br /> ENR index without being subject to a Proposition 218 vote of current property owners. <br /> Staff did not schedule an informational meeting this year as there were no public <br /> inquiries in the past year. Staff recommends the GHAD Board schedule the public <br /> hearing for June 20, 2023, at 6:55 p.m. to receive comments on the proposed <br /> assessments. Additionally, public notices will be sent to all property owners within each <br /> GHAD notifying them that this agenda report is available on the City's website (in <br /> addition to the normal postcard noticing information). Any questions from owners will be <br /> presented to the GHAD Board of Directors, along with staff responses, on or before the <br /> June 20, 2023, agenda report. <br /> Contract Amendment with GHAD Consultant <br /> Despite performing maintenance within each GHAD prior to the arrival of winter storms, <br /> the Laurel Creek GHAD experienced a minor landslide that damaged an access road <br /> extending west of Crosby Drive to Dublin Canyon Road. The damage must be assessed <br /> by the City's consulting geotechnical engineer, ENGEO, Inc., in order to develop a <br /> repair scheme. The repair can then be implemented in fall 2023 together with other <br /> routine GHAD maintenance. <br /> The ENGEO Inc., cost proposal exceeds the amount available from the original contract <br /> plus contingency. The original contract presented to the City Council on December 15, <br /> 2020, limited total expenditures during the four-and-one-half-year term to $116,907. Of <br /> this amount, $112,909 has been encumbered, leaving $3,998 available. ENGEO's <br /> proposal for the damage assessment and repair scheme is $22,500. As such, the City <br /> must authorize a contract amendment in the amount of $18,502 for the work within the <br /> Laurel Creek GHAD to proceed. This will bring ENGEO's current contract amount to <br /> $135,409 for all CHAD-associated consulting work.
