Ordinance No.2245 <br /> Page 17 of 34 <br /> 48. POTABLE WATER NETWORK RECONFIGURATION. Reconfiguration of the City's potable <br /> water network to accommodate the project shall be performed in accordance with the <br /> "Stoneridge Apartments Project Hydraulic Analysis" prepared by Akel Engineering Group <br /> dated November 30, 2022, and in accordance with City Standard Details and Specifications. <br /> (Address this condition prior to plan approval) (Project Specific Condition) <br /> 49. POTABLE WATER METERS. Depict the size of the new domestic and irrigation water <br /> meters on the plans. (Address this condition prior to plan approval) (Project Specific <br /> Condition) <br /> 50. DEEPENED CURBS. Provide a deepened curb where bioretention areas are proposed near <br /> the roadway, sidewalk, buildings, etc. (Address this condition prior to plan approval) (Project <br /> Specific Condition) <br /> 51. SUBDIVISION. The application materials show a new property line along the west edge of <br /> the project. Introducing a new property line will require a subdivision prepared in accordance <br /> with California Government Code §66444 and Pleasanton Municipal Code Title 19. Since <br /> access and private utilities will then be shared between the original parcel and the newly <br /> created parcel, the subdivision should identify the "common area" within each of the new <br /> parcels as defined in the Construction, Operation, and Reciprocal Easement Agreement <br /> recorded as Series No. 78-098534. (Address this condition if/when subdivision of the <br /> property is desired) (Project Specific Condition) <br /> 52. PUBLIC EASEMENT ABANDONMENTS. Referring to the report by Fidelity National Title <br /> Insurance Company, the applicant shall address the following encumbrance: Exception #8 <br /> describes a Development Agreement (DA) recorded on 4-02-1993 as Series No. 93-103418, <br /> First Amendment to DA recorded on 1-06-1998 as Series No. 98-048535, a Second <br /> Amendment to DA recorded on 9-05-2013 as Series No. 2013-299219, and a Third <br /> Amendment to DA recorded on 9-19-2018 as Series No. 2018-182964. Section 4.5 <br /> "Easements; Improvements" (Page 11) of the DA includes the following language: <br /> "City shall cooperate with Developer in connection with any arrangements for abandoning <br /> existing utility or other easements and facilities and the relocation thereof or creation of any <br /> new easements within the Property necessary or appropriate in connection with the <br /> development of the Project." <br /> Portions of the public services easements (PSE) described in the report will require <br /> abandonment and relocation. The abandonment process shall follow California Streets and <br /> Highways Code §8300 et seq. A replacement PSE shall then be dedicated to the City by <br /> separate instrument across the new alignments of the public sanitary sewer and water <br /> pipelines (i.e. Drive Aisles A and B plus the Pedestrian Plaza). Note that the DA is currently <br /> scheduled to terminate on 12-31-2023. (Address this condition prior to plan approval) <br /> (Project Specific Condition) <br /> 53. STORMWATER AGREEMENT. Referring to the report by Fidelity National Title Insurance <br /> Company, the applicant shall address the following encumbrance: Exception #10 describes <br /> a Stormwater Treatment Measures Inspection and Maintenance Agreement (O&M <br /> Agreement) recorded on 12-27-2006 as Series No. 2006-470039. This O&M Agreement was <br /> executed when improvements were made to the southwest area of the applicant's property. <br /> The current application involves the southeast area. Said O&M Agreement shall be amended <br /> to include areas where additional stormwater treatment measures are installed.
