ORDINANCE NO. 2245 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING <br /> AN APPLICATION FOR A PLANNED UNIT DEVELOPMENT (PUD) PLAN FOR SIMON <br /> PROPERTY GROUP AS FILED UNDER CASE NO. PUD-136 <br /> WHEREAS, on May 29, 2019, Simon Property Group ("Applicant") submitted an application <br /> for a Planned Unit Development (PUD) Plan to construct 360 multi-family apartment units and related <br /> site improvements including a new parking structure (the "Project") on real property commonly known <br /> as 1008 Stoneridge Mall Road consisting of portions of Assessor Parcel Numbers 941-1201-94-03 <br /> and 941-1201-04-06 (the "Property"); and <br /> WHEREAS, the City of Pleasanton is the lead agency on the Project, and the City Council is <br /> the decision-making body for the proposed approval of the Project; and <br /> WHEREAS, the Project was subject to the Supplemental Environmental Impact Report (SEIR) <br /> and California Environmental Quality Act (CEQA) Findings and a Statement of Overriding <br /> Considerations for the Housing Element Update and Climate Action Plan General Plan Amendment <br /> and Rezonings certified and adopted by the City Council on January 4, 2012; and that SEIR was a <br /> supplement to the Environmental Impact Report (EIR) prepared for the Pleasanton 2005-2025 <br /> General Plan which was certified on in July 2009; further, the Property was one of 21 potential housing <br /> sites analyzed in the SEIR and is, therefore, within its scope of review, and the SEIR included some <br /> mitigation measures that needed to be addressed prior to issuance of a building permit for a project, <br /> and these mitigation measures have been addressed in the Conditions of Approval for the Project; <br /> and <br /> WHEREAS, the City prepared an Addendum to the aforementioned SEIR and EIR, which <br /> evaluated the Project and concluded that none of the circumstances referenced in CEQA Guidelines <br /> 15183 or 15162 have occurred (Addendum); and <br /> WHEREAS, the Property is designated Mixed Use in the General Plan; and <br /> WHEREAS, the Property is designated PUD-MU (Planned Unit Development—Mixed Use) on <br /> the City's zoning map; and <br /> WHEREAS, on March 11, 2020, the Planning Commission, following public notice, conducted <br /> a work session regarding the Project; and <br /> WHEREAS, on February 22, 2023, the Planning Commission reviewed the Addendum and <br /> Mitigation Monitoring and Reporting Plan (MMRP) for the Project, in accordance with Sections 15162 <br /> and 15183 of the CEQA Guidelines and recommended adoption to the City Council; and <br /> WHEREAS, on February 22, 2023, the Planning Commission, following public notice, <br /> conducted a public hearing where it considered the written agenda report, public testimony, related <br /> materials for the Project, and adopted Resolution PC-2023-06, determining that the proposed PUD <br /> development plan, are appropriate for the site, making the findings, and recommending to the City <br /> Council the Project be approved; and <br /> WHEREAS, on March 21, 2023, the City Council held a duly noticed public hearing on the <br /> Project and considered all public testimony, agenda reports; and related materials, and the <br /> recommendations of City staff and the Planning Commission; and <br />
