RESOLUTION NO. 23-1376 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADOPTING <br /> A CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) ADDENDUM AND <br /> MITIGATION AND MONITORING REPORTING PLAN (MMRP) FOR THE <br /> APPLICATION OF SIMON PROPERTY GROUP AT 1008 STONERIDGE MALL ROAD, <br /> AS FILED UNDER CASE NO. PUD-136 <br /> WHEREAS, on May 29, 2019, Simon Property Group ("Applicant") submitted an <br /> application for a Planned Unit Development (PUD) Plan to construct 360 multi-family apartment <br /> units and related site improvements including a new parking structure (the "Project") on real <br /> property commonly known as 1008 Stoneridge Mall Road consisting of portions of Assessor <br /> Parcel Numbers 941-1201-94-03 and 941-1201-04-06 (the "Property"); and <br /> WHEREAS, the City of Pleasanton is the lead agency on the Project, and the City Council <br /> is the decision-making body for the Project; and <br /> WHEREAS, the Project was subject to the Supplemental Environmental Impact Report <br /> (SEIR) and California Environmental Quality Act (CEQA) Findings and a Statement of Overriding <br /> Considerations for the Housing Element Update and Climate Action Plan General Plan <br /> Amendment and Rezonings (State Clearinghouse No. 2011052002) certified and adopted by the <br /> City Council on January 4, 2012; and that SEIR was a supplement to the Environmental Impact <br /> Report (EIR) prepared for the Pleasanton 2005-2025 General Plan (State Clearinghouse No. <br /> 205122139) which was certified on in July 2009; further, the Property was one of 21 potential <br /> housing sites analyzed in the SEIR and is, therefore, within the scope of review of the SEIR, and <br /> the SEIR included some mitigation measures that needed to be addressed prior to issuance of a <br /> building permit for a project, and these mitigation measures have been addressed in the <br /> Conditions of Approval for the Project; and <br /> WHEREAS, the City prepared an Addendum and MMRP to the aforementioned SEIR and <br /> EIR which evaluated the Project and concluded that none of the circumstances referenced in <br /> CEQA Guidelines 15183 or 15162 have occurred (Addendum); and <br /> WHEREAS, on March 11, 2020, the Planning Commission, following public notice, <br /> conducted a work session regarding the Project; and then at its regular meeting on February 22, <br /> 2023, adopted Resolution PC-2023-06, determining the proposed Addendum and MMRP is <br /> appropriate for the Project. making the requisite findings, and recommending the City Council <br /> adopt the proposed Addendum for the Project; and <br /> WHEREAS, at its duly noticed public meeting of March 21, 2023, the City Council received <br /> and reviewed the Addendum and MMRP, considered the written agenda report, all public <br /> testimony, relevant exhibits, and Planning Commission and staff recommendations. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds it has independently reviewed and analyzed the Addendum and <br /> MMRP and other information in the record. including the EIR as supplemented by the SEIR. and <br /> has considered the information contained therein, prior to approving the Project; the Addendum <br /> and MMRP has been completed in compliance with CEQA; and the Addendum and MMRP <br />
